⚠️Today the US Senate unanimously passed the House bill banning enriched #Uranium imports from #Russia🇷🇺⚛️⛏️🚢⛔️🇺🇸 beginning 90 days after President Biden writes his signature.📜✍️
Senate passage came just minutes after a meeting held by the Department of Energy to brief the US #Nuclear Energy Institute and other representatives of US utilities on the waivers granting process to be followed on a case by case basis.🧾 Starting 90 days after enactment, no further US deliveries of Russian enriched uranium under existing contracts with Russian suppliers will be permitted, unless a waiver is granted.👋
Journalists do investors a disservice by glossing over the "waiver" provision as if it gives US #Nuclear utilities full authority to import Russian uranium up to the bill's stated limits until 2028, which is clearly not the case.✖️
The law will only allow granting of a waiver to 'at risk' individual reactors or their operating utility if “no alternative viable source of low-enriched uranium is available" from any non-Russian supplier worldwide.🏜️
If individual US reactor operators want to import Russian uranium they'll have to ask for a permission slip from the Secretary of Energy, providing proof that all other non-Russian enriched uranium suppliers are 'sold out' worldwide and that the only viable source available is Russia.😯
The total number of permission slips issued in any given calendar year must not exceed the limits imposed by the law. Each recipient's name will also be posted on a wall of shame.😬

World prices for Uranium are set in western markets, so where will prices be headed if US fuel buyers are granted waivers because all western enriched uranium warehouses are completely empty?💲🌜😲
That's not a blanket waiver... it's the exception of last resort when all other commercial avenues to securing non-Russian enriched uranium fuel have failed.🌎⚛️⛏️🛒✖️
And here's the rub.🐈 The uranium feed requirements associated with those Russian enriched uranium (EUP) supply contracts are around 20% lower than the feed requirements in EUP supply contracts signed with western enrichers today, due to the overfeeding being done in order to increase the EUP production quantities to replace that lost Russian supply.🍼🍼
Utilities faced with losing their Russian EUP deliveries will have to come to the Spot uranium market to top up their uranium feed holdings by another 20+% to meet the higher feed requirements of western contracts for the same quantity of EUP they were expecting from Russia.😫 I heard a rumour last Friday that a utility has a new 15 Million lbs order that they need to get filled.😱
However, if Russia decides to retaliate by blocking the export of ALL of its enriched uranium supply to the USA, then there will be NO Russian uranium being imported to provide fuel to the world's largest reactor fleet, waivers or not! 🇷🇺⚛️⛏️🚢✖️
Vulnerable US utilities holding EUP supply contracts with Russia are going to have to enter the Spot U3O8 and Conversion markets now in case Russia enacts an export ban or their waiver request to the DoE is denied. They'll be buying up all available supply before non-Russian suppliers are completely sold out.🛒😟

⚡️Word on the street in DC now is that the likelihood of a US ban on imports of enriched #Uranium from #Russia is near 100%.🦻🐦🏛️ Here's why:
On Saturday, March 9th, President Biden signed into law H.R. 4366, the “Consolidated Appropriations Act, 2024”, which included $2.72 Billion to fund provisions to boost the US domestic Uranium industry in the Nuclear Fuel Security Act (NFSA) passed into law in December.
The NFSA provides the means to increase domestic production of low-enriched uranium (LEU) needed by the current US Nuclear reactor fleet and high-assay LEU (HALEU) needed for upcoming advanced SMR's, and to expand the strategic 'Uranium Reserve' emergency stockpile of US-mined #U3O8 thru direct purchases from US miners, in order to end US dependence on imports of Russian enriched uranium.
However, in the fine print on page 448 of H.R. 4366 it states that:
(b) Amounts may not be repurposed or transferred pursuant to this section until a law is enacted or administrative action is taken to prohibit or limit importation of LEU and HALEU from the Russian Federation or by a Russian entity into the United States.

In other words.. the $2.72 Billion will NOT go to the Department of Energy to fund the NFSA UNLESS the Senate passes the Prohibiting Russian Uranium Imports Act OR President Biden signs an Executive Order that does what the Prohibiting Russian Uranium Imports Act is intended to do.
Here's the rub🐈...
The Biden Administration has committed the US to supporting its allies in boosting the production of western enriched uranium (LEU and HALEU) as declared at COP28 with Canada, Japan, the UK, and France. It reaffirmed that commitment yesterday at the world's first Nuclear Energy Summit in Brussels, reiterating that it WILL fund US domestic enriched uranium to the tune of $2.7 Billion.
The Biden Administration is also committed to ensuring that there is sufficient HALEU reactor fuel for US Small Modular Reactors being deployed, such as Bill Gates' Natrium SMR in Wyoming that will begin construction in June. The US reaffirmed its COP28 pledge yesterday in Brussels to triple US Nuclear capacity by 2050. That relies heavily on a successful SMR build-out program and associated HALEU fuel supply, which will also enable the US to become a major SMR exporter to the rest of the world in order to compete with China and Russia.⚔️
These commitments, along with the publicly-stated goal to end US reliance on imports of Russian uranium so as to halt US backdoor financing of Putin's war in Ukraine, must be upheld so that the Biden Administration can deliver on its many promises and deliver on a US-led Nuclear renaissance that is not dependent on Russia.
Bottom line... Whether by Senate passage of the Prohibiting Russian Uranium Imports Act or by Executive Order, there WILL be a US prohibition on imports of Russian Uranium very soon! 🤠🐂
