JUST IN—FULL ACQUITTAL: Both of my clients ACQUITTED this morning in State v. Murray / Brown (case no. 2023-MM-6485) after a bench trial held last week. In 2023 the Florida legislature passed an unconstitutional law against “hate speech & anti-semitism” (HB 269), also known as the Public Nuisances Bill.
In an act of pure viewpoint discrimination, the defendants were arrested by FDLE & charged under the law for illegally protesting. They were targeted based on the content of their speech, despite the fact that the First Amendment protects all viewpoints, whether offensive or innocuous.
Due to the facially overbroad & unconstitutional way the law was drafted, the Judge agreed with our arguments & acquitted our clients.
Now that the criminal case is over, I will be filing a federal civil lawsuit under Section 1983 for First Amendment viewpoint discrimination & to have the law permanently enjoined. ✔️
