🗞 Joint Statement

New Delhi; 27 April 2026
The Constitution of India guarantees religious freedom under Articles 25 and 26, while Article 30 grants religious minorities the full right to establish and administer their own educational institutions.

There is no doubt that, in our beloved country, religious seminaries (madrasas) are among the most vital institutions for the preservation of our religious values. The Constitution of India has recognized these rights as Fundamental Rights; therefore, their protection is a collective responsibility of the Muslim community. Madrasas have played a significant role in the freedom and development of the country and continue to do so even today. However, it is deeply regrettable that certain elements, who have attained power through divisive and hate-driven politics, are attempting to deprive Muslims and other minorities of their religious identity. As part of this ongoing pattern, there appears to be a concerted attempt to undermine Islamic seminaries.

Recently, the Government of Uttarakhand has introduced a bill under which it is being made mandatory for all madrasas to register with a government educational board. Furthermore, the educational board will determine what religious content may or may not be taught, and the curriculum will also be that which is prescribed by the government.

We believe that this law is in clear violation of the guarantees and Fundamental Rights enshrined in the Constitution; indeed, it is also contrary to the very expectations from a secular state. Therefore, opposing it and preserving the constitutionally guaranteed autonomy of madrasas is the responsibility of the entire Muslim community. In this regard, all representative organizations stand with you and will extend their fullest possible support to the madrasas. Some cases related to this matter are currently under consideration before the Uttarakhand High Court, and if necessary, the matter will also be taken to the Supreme Court.

ہندوستان کے آئین میں دفعہ 25 اور 26 کے تحت مذہبی آزادی کی ضمانت دی گئی ہے، جبکہ دفعہ 30 کے تحت مذہبی اقلیتوں کو اپنے تعلیمی ادارے قائم کرنے اور انہیں چلانے کا مکمل حق حاصل ہے۔
اس میں کوئی شبہ نہیں کہ وطن عزیز میں دینی مدارس ہمارے مذہبی اقدار کے تحفظ کا اہم ترین ذریعہ ہیں اور ��ئین ہند نے ان حقوق کو بنیادی حقوق (Fundamental Rights) کے طور پر تسلیم کیا ہے؛ اس لیے ان کی حفاظت ملت اسلامیہ کی مشترکہ ذمہ داری ہے، مدارس نے ملک کی آزادی اور ترقی میں اہم کردار ادا کیا ہے اور آج بھی کر رہے ہیں۔ لیکن افسوس کہ نفرت انگیز سیاست کے ذریعے اقتدار حاصل کرنے والے بعض عناصر مسلمانوں اور دیگر اقلیتوں کو ان کی مذہبی شناخت سے محروم رکھنے کی کوشش کر رہے ہیں، اسی سلسلے کی ایک کڑی مدارس اسلامیہ کو نقصان پہنچانے کی سازش ہے، گزشتہ دنوں اتراکھنڈ حکومت ایک بل لے کر آئی ہے ، جس کے تحت تمام مدارس کو سرکاری تعلیمی بورڈ میں رجسٹر کرانا لازمی قرار دیا جا رہا ہے اور آئندہ تعلیمی بور�� یہ بھی طے کرے گا کہ مذہب سے متعلق کیا تعلیم دی جائے اور کیا نہیں، نیز نصاب بھی وہی ہوگا ، جو حکومت کی طرف سے مقرر کیا جائے گا۔
ہمارا ماننا ہے کہ یہ قانون آئین میں دی گئی ضمانتوں اور بنیادی حقوق کے سراسر خلاف ہے؛ ��لکہ ایک سیکولر ریاست سے جو توقع کی جاتی ہے، اس سے بھی متصادم ہے؛ اس لیے اس کی مخالفت کرنا اور آئین میں دی گئی مدارس کی آزادی کو برقرار رکھنا پوری ملت اسلامیہ کی ذمہ داری ہے، اس سلسلے میں تمام ملی تنظیمیں آپ کے ساتھ ہیں اور مدارس کا بھر پور ممکنہ تعاون کریں گی، اس معاملے میں کچھ مقدمات اتراکھنڈ ہائی کورٹ میں زیرِ سماعت ہیں اور ضرورت پڑنے پر سپریم کورٹ سے بھی رجوع کیا جائے گا۔

Strong Condemnation of Open Aggression by the United States and Israel Against Iran.
United Nations Must Ensure Immediate Ceasefire and Intervention
All India Muslim Personal Law Board

The All India Muslim Personal Law Board strongly and unequivocally condemns the joint and open aggression carried out by the United States and Israel against Iran. The Board urges the United Nations and the international community to take immediate, effective, and concrete steps to ensure a ceasefire and prevent the region from descending into a devastating war.

In a press statement, the Board’s Spokesperson, Dr. S. Q. R. Ilyas, stated that significant progress had been made in negotiations between Iran and the United States regarding Iran’s nuclear program. According to Oman’s Foreign Minister, Badr Al-Busaidi, who was mediating the talks, Iran had agreed to almost all of the United States’ conditions. Despite this, the sudden announcement by the United States to terminate the negotiations, followed immediately by a joint attack on Iran with Israel, indicates that the negotiations were merely a pretext rather than a serious diplomatic effort.

Dr. Ilyas expressed deep sorrow and grief over the martyrdom of Iran’s Supreme Leader, Ayatollah Khamenei, describing it as a great loss for the Muslim Ummah. He stated that targeting the central leadership of a sovereign country during wartime and openly speaking of regime change constitutes a blatant violation of international law and the Charter of the United Nations.

He further noted that this war has engulfed the entire Middle East in instability. While several European countries are supporting the United States, Russia and China are backing Iran. If immediate and effective diplomatic intervention is not undertaken, this conflict could escalate into a wider global war. A prolonged war would not only deepen the humanitarian crisis but also severely impact the global economy, with developing and weaker nations bearing the greatest burden.

Dr. Ilyas expressed regret that at such a critical and decisive moment, our country could have played a balanced and dignified mediatory role. However, the current approach has adversely affected the credibility of the country’s foreign policy. He also expressed concern that no official condolence message was issued on the martyrdom of Ayatollah Khamenei, which, he said, goes against our moral and diplomatic traditions.

The All India Muslim Personal Law Board once again appeals to the country’s leadership, the United Nations, and the international community to take immediate, serious, and practical measures to stop this war. Otherwise, this fire will not remain confined to one region, and no country will remain untouched by its consequences.

The central government’s notification making it mandatory to recite all verses of “Vande Mataram” in schools and official functions is unconstitutional, against religious freedom, secular values, and contrary to the Supreme Court’s Judgment. The song contains references to the worship and veneration of Durga and other deities, which directly contradicts the beliefs of Muslims; therefore, it is entirely unacceptable for them. Muslims worship only one God; Allah, without partner, and Islam does not permit any form of associating partners with God. Indian courts have also held that the many verses of song are inconsistent with secular values and have restricted their recitation. Therefore, AIMPLB demands that the central government should immediately withdraw this notification; otherwise, the All India Muslim Personal Law Board will challenge it in court.

مرکزی حکومت کے ”وندے ماترم“ تمام اشعار کو اسکول و سرکاری تقریبات میں لازمی قرار دینے کا نوٹیفیکیشن غیر آئینی، مذہبی آزادی و سیکولر اقدار کے منافی اور عدالت عظمیٰ کے فیصلے کے خلاف ہے۔ اس میں درگا اور دیگر دیویوں اور دیوتاؤں کی پوجا اور وندنا کی بات کہی گئی ہے۔ جو مسلمانوں کے عقیدے سے راست متصادم ہے، اس لئے مسلمانوں کے لئے یہ ہرگز بھی قابل قبول نہیں ہے۔ کیونکہ مسلمان صرف ایک اللہ وحدہ لا شریک کی ہی عبادت کرتا ہے، اسلام خدا کی ذات میں ذرہ برابر بھی شرک کو برداشت نہیں کرتا۔ ملکی عدالتوں نے بھی اس کے دیگر اشعار کو سیکولر اقدار کے منافی قرار دیتے ہوئے ان کے پڑھے جانے پر پابندی عائد کر رکھی ہے۔ لہذا مرکزی حکومت سے ہمارا مطالبہ ہے کہ وہ فی الفور اس نوٹیفیکیشن کو واپس لے بصورت دیگر آل انڈیا مسلم پرسنل لا بورڈ اسے عدالت میں چیلینج کرے گا۔

Inflammatory and Poisonous Rhetoric Against Muslims by Assam Chief Minister
Supreme Court Must Take SUO MOTU Cognisance

New Delhi, January 30, 2026
The All India Muslim Personal Law Board strongly condemns the recent anti-Muslim and deeply divisive statements made by Assam Chief Minister Himanta Biswa Sarma. The Board has urged the Hon’ble Supreme Court of India to take immediate suo motu cognisance of this grave matter.

In a statement, the Board’s Spokesperson, Dr. S. Q. R. Ilyas, said that hate speech and open incitement against Muslims are fast becoming normalized in the political discourse of the ruling party. What was once limited to fringe voices is now being echoed by those occupying the highest constitutional offices. Chief Ministers of Uttarakhand, Uttar Pradesh, and now Assam have repeatedly made inflammatory and unconstitutional remarks targeting Muslims.

The Assam Chief Minister, while addressing a government function in Tinsukia, reportedly called for the harassment of the “Miyan” community so that they are forced to leave Assam. He is also reported to have said that causing hardship to this community was his responsibility. Additionally, he publicly encouraged people to file Form No. 7 to remove 4–5 lakh Muslims from the voter rolls and called for their economic boycott.

Dr. Ilyas said it is shocking and unacceptable that a Chief Minister, who has sworn to uphold the Constitution, is seen openly advocating discrimination, harassment, and disenfranchisement of a particular community. Such statements strike at the very foundation of constitutional governance, the rule of law, and the principle of equality before law. If constitutional authorities like the Election Commission fail to resist such unlawful pressure, the credibility of free and fair elections itself will be in jeopardy.

The Board has also appealed to the Hon’ble President of India to take appropriate constitutional action against the Assam Chief Minister for these dangerous and unconstitutional remarks. The Chief Justice of India has been urged to intervene without delay. Failure to act firmly and swiftly may embolden further hate speech and create conditions of social unrest and lawlessness.

The Board calls upon all secular political parties, civil society groups, and justice-loving citizens to take serious note of this open call for discrimination and stand united in defense of constitutional values.
At the same time, the Board appeals to the Muslims of Assam to remain calm and respond to these provocations strictly through constitutional and legal means.

آسام کے وزیر اعلی ہیمنتا بسوا شرما کی مسلمانوں کے خلاف حالیہ زہر افشانی انتہائی قابل مذمت اور تشویشناک ہے۔ آل انڈیا مسلم پرسنل لا بورڈ نے سپریم کورٹ آف انڈیا سے مطالبہ کیا کہ وہ فوری طور پر اس کا SUO MOTTO نوٹس لے۔
آل انڈیا مسلم پرسنل لا بورڈ کے ترجمان ڈاکٹر سید قاسم رسول الیاس نے ایک پریس بیان میں کہا کہ مسلمانوں کے خلاف زہر افشانی، نفرت انگیز بیانات اور زہریلی تقاریر اب بی جے پی کا طرہ امتیاز بنتی جارہی ہے۔ دوسرے اور تیسرے درجہ کے رہنماء تو آئے دن ایسا کرتے ہی رہتے ہیں مگر اب اس کی اعلی سطح کی قیادت بھی اس میں ملوث ہوتی جارہی ہے۔ اتراکھنڈ، یوپی اور آسام کے وز��ائے اعلی اس طرح کی بیان بازیاں کرتے رہتے ہیں۔ آسام کے وزیر اعلیٰ نے تن سکھیا کے ایک سرکاری پروگرام کے موقع پر عوام سے کہا کہ وہ میاں لوگوں کو ستائیں تاکہ وہ پریشان ہوکر آسام چھوڑدیں۔ اس موقعہ پر صحافیوں سے بات کرتے ہوئے انہوں نے کہا میاں طبقے کو تکلیف پہونچانا ان کی ذمہ داری ہے۔ انہوں نے آسامی لوگوں سے کہا کہ وہ فارم نمبر 7 داخل کرکے 4 تا 5 لاکھ مسلمانوں کو ووٹر لسٹ سے باہر نکال دیں۔ انہوں نے عوام سے مزید کہا کہ وہ مسلمانوں کو معاشی طور پر بھی پریشان کریں۔
ڈاکٹر الیاس نے اس پر انتہائی تعجب سے کہا کہ ایک وہ شخص جو ملک کے دستور پر حلف لے کر وزیر اعلیٰ بنتا ہے کس طرح ایسے غیر قانونی احکامات جاری کرسکتا ہے۔ اگر الیکشن کمیشن ایسی ناجائز حرکتوں کے آگے سپر ڈال دے تو پھر کس طرح ملک میں صاف ستھرے انتخابات ہوسکتے ہیں۔ ہم سب سے پہلے تو صدر جمہوریہ ہند سے اپیل کرتے ہیں کہ وہ آسام کے وزیر اعلیٰ کے ان متنازعہ اور غیر دستوری بیانات پر سخت کاروائی کریں۔ اسی طرح ہم چیف جسٹس آف انڈیا سے بھی اپیل کرتے ہیں ��ہ وہ فوری طور پر اس پر SUO MOTTO نوٹس جاری کریں۔ اگر ایسا نہیں کیا گیا تو اندیشہ ہے کہ اس سے ملک میں بدامنی و انارکی پیدا ہوجائے گی۔
بورڈ کے قومی ترجمان نے ملک کی سیکولر پارٹیوں اور انصاف پسند شہریوں سے بھی مطالبہ کیا کہ وہ اس زہر افشانی اور غیر قانونی حرکت کا سختی سے نوٹس لیں۔ آل انڈیا مسلم پرسنل لا بورڈ نے آسام کے مسلمانوں سے بھی اپیل کی ہے کہ وہ اس طرح کی مذموم حرکتوں سے ہرگز بھی پریشان نہ ہوں اور آئینی و قانونی راستوں سے اس کا مقابلہ کریں۔
