@Nath_Rake@epdevilla We still need that declaration from the Ontario Court of Appeal to determine liability. The police were acting as private security to enforce @epdevilla 's trespass order, so my understanding is that she would be the responsible party, not TPS
After 5 years, I've been absolved of criminality.
While I maintain that the lockdown measures of the ROA were unconstitutional, and @epdevilla seized my building without right (the Ontario Court of Appeal will make determinations on this), the Crown has been reasonable and fair throughout this process. I appreciate their on-record acknowledgement that the BBQ Rebellion was charter protected activity.
More to come on our appeal to the Constitutional Application dismissal once it's scheduled.
@CrockpotIi@AriGoldkind@TorontoStar Our seizure arguments were applied to Eileen DeVilla's issuance of a TPA notice on my restaurant (outside her statute the HPPA) not a general lockdown order.
@CrockpotIi@AriGoldkind@TorontoStar That was how Toronto Star characterized our arguments in their headline. You won't find that anywhere in our submissions.
We thank Justice Janet Leiper for her swift decision! Find here the full reasons:

Be quick to hear! Put aside any anger, we have received grounds for appeal implanted in her reasons.
The one who looks into the perfect law, the law of liberty, and perseveres, being no hearer who forgets but a doer who acts, he will be blessed in his doing!
@jingz9292@AriGoldkind@TorontoStar Yes and that is why we sought public interest standing in our case (Justice Leiper did not answer this in her decision)
Today, seven Air Canada pilots won their arbitration over denial of religious exemptions for C19 jabs, and were awarded compensation. Portions of their testimonies are in the ruling - a must read, link below.
Arbitrator Hayes: "All of the grievors testified honestly and the substantive nexus between their religious beliefs and objections to the employer mandatory vaccination policy was manifest."

@stevenman47@trmpwn@TheMenzoid I was talking about the restaurant owners you mentioned. Do you require a background check from every person you shake hands with?
@stevenman47@trmpwn@TheMenzoid Go on the City of Toronto Interactive Zoning Map and tell me 176 Wicksteed Avenue isn't zoned for restaurant use. Then ask yourself, why did they allow us to operate since 2016 with less fines than the costs of annual licenses? There's much more to the story.
Our original challenge in 2021 was dismissed on procedural grounds. The lawyer didn't file an "originating process" like a "notice of application".
The more I learn about our Court system, the more I respect it. It's not corrupt. People are.
@VirtualRageMstr@Humanlty1o1 CORRUPT COURTS = “A constitutional challenge against the Reopening Ontario Act (ROA), which was raised by Adam Skelly, owner of Adamson Barbecue, has been dismissed by a Superior Court judge.”
