Dies ist der Gruppenvergewaltigungsfall aus 2016 aus Hamburg, auf den sich der Tarantino -artige Film "Ein Mann sieht rot", (#CitizenVigilante von @BollFILMS), auf X gestellt von @elonmusk, bezieht. Ich habe diesen Fall und den furchtbaren Richter damals im Oktober 2016 ausführlich beschrieben.
Unser damaliges Fazit:
"Die Produktion von jugendlichen „Intensivtätern“ ist eine wahrhafte Pestbeule der reinen und nur wohlmeinenden Justiz. Eine lückenlose Kette von fehlerhaften „Sozialprognosen“ gespickt mit Hätscheleinheiten und einer ebenso langen Kette von hoheitlich geopferten Opfern. Das ist ein real existierendes Geschehen, das man ungeschönt als Pestbeule der Justiz bezeichnen muss. Intensivtäter kann jemand nur werden, der intensiv jedes Mal neu von der Justiz verkannt wurde. Ohne dieses Verkennen könnte es keine Intensivtäter geben.
Das Urteil ist strukturelle Gewalt gegen das Opfer
In der Bundesrepublik hat sich das Strafrecht kontinuierlich zu einem Täterrecht entwickelt. Im Jugendstrafrecht gilt das in gesteigerter Weise. Da werden die Täter, denen das Leben nicht verbaut werden soll – Geld spielt im wahrsten Sinne des Wortes nicht die geringste Rolle – gehätschelt und gepäppelt, ihnen gilt die Medienaufmerksamkeit und alle öffentliche Fürsorge und die Opfer haben die doppelte Arschkarte gezogen.
„Die 14-Jährige sei zum Objekt degradiert worden, sagt Halbach. Schließlich hätten die Täter sie im Hof weggeworfen wie Müll. „Das Opfer habe sich nach der Tat stark zurückgezogen und nur noch schwer Vertrauen fassen können, berichtet Halbach. Im Prozess habe die 14-Jährige nicht befragt werden können. „Wir wissen nicht, wo sie ist.“
Nicole wird in den Medien ganz leicht wie ein „gefallenes Mädchen“ behandelt, das, wie es an einer Stelle heißt, nach Berlin „abgehauen“ sei und sich als „Straßenkind“ durchschlüge.
Nein, Nicole wollte sich nur die Öffentlichkeit nicht mehr antun, so ihre Anwältin.
Auch jugendliche Täter müssen es erdulden, dass sie von den anhaltenden Traumata ihres Opfers betroffen bleiben. Das Jugendstrafrecht, als große Errungenschaft immer wieder gefeiert, wird angesichts völlig neuer Täterprofile und Tätermilieus zu einem Opfer-Unrecht. Und Heere von Ideologen, die sich unter den Kriminologen vermehrt finden und unter den überaus fürsorglichen Jugendrichtern sicherlich auch, haben die Waage des Rechtes verschoben. Insofern ist das Urteil des Herrn Halbach womöglich ein strukturelles Problem, strukturelle Gewalt gegen das Opfer."
