US v. Miller (1939) upheld the NFA because the short barreled shotgun he "illegally" possessed was unusual for militia use. To quote:
"The Court cannot take judicial notice that a shotgun having a barrel of less than 18 inches in length has today any reasonable relation to the preservation or efficiency of a well regulated militia, and therefore cannot say that the Second Amendment guarantees to the citizen the right to keep and bear such a weapon."
An AR-15 is functionally near identical to an M16 with few minor parts exchanged. Stop saying they're different; they are not. The problem isn't that an AR is able to take all but maybe 3 parts in the M16 (the auto sear, spring, and pin), but rather that we keep arguing that its a different weapon as if that would save it from their banhammer, when in reality they have no right to touch it at all and those 3 parts are in fact protected as well; we simply don't defend them. Stop using their defeatist language. Stop kowtowing.

@MAC_Arms@Mike_McD5511 Yes, and weapons of war are deliberately covered by the 2nd Amendment. AR15s are absolutely weapons of war and that's exactly why the government can't constitutionally touch them.
