@floresandresss Good point, except for one nuance. PP 10998 included Angola and Nigeria, so Alfonso-Royals' point about those 2 countries may be more relevant to PM-602-0194. But not Ethiopia, Liberia, and Pakistan - none of that makes sense.
The Alfonso-Royals declaration offers ten countries as evidence of the vetting deficiencies that make a stay necessary — yet five of those countries (Nigeria, Pakistan, Liberia, Ethiopia, Angola) are not covered by PM-602-0192 or PM-602-0194, and upon information and belief, benefit applications from nationals of those countries continued to be adjudicated throughout the period the challenged policies were in effect. The government cannot credibly assert that adjudicating cases from countries with document credibility concerns constitutes irreparable harm when its own agency was doing precisely that for the majority of the countries cited in its declarant’s sworn testimony. This is not a minor evidentiary gap — it is a fundamental disconnect between the declaration’s factual predicate and operational reality that strips the irreparable harm showing of any evidentiary foundation.
