SEC correctly classifies HNT as a security, why? Because people have an expectation of profit as evidenced by comments of the CEO/COO & the value of HNT is directly tied to the efforts of Nova in onboarding clients, that’s the definition of security.
2/ Make significant revenue from the sale of hotspots and the value of HNT
That the hotspot sales were specifically designed by the CEO to “cheat securities laws”.
Read the whole filing and then make your opinions known
1/ Helium SEC: Firstly HNT meets every definition of a security but, that aside, the allegations include:
Nova getting kickbacks from IOT hotspot makers;
CEO and COO suggesting publicly that buying a hotspot would generate profits;
That the CEO stated the intention to
The SEC is suing @helium.
You can't just resell T-Mobile network and sell a token, pretending the two are related.
#WorldMobile is ACTUALLY a DePIN network. Legally defendable.
Still, never like to see the SEC come after projects. $WMTX https://t.co/rb4fR2Ye3y
So SEC says if you sell “miners” that reward in a native coin and that coins price is impacted by BD efforts of the underlying business then it’s a security. DePIN’s need to pivot to revenue share to survive, but they won’t, because there’s no revenue to share.
Hey @brian_armstrong,
Can you tell my fiance that we can't get married at the venue we picked because @coinbase:
- refused to let me withdraw my deposit
- won't let me access my funds for another 2 months
I've had the same bank account since I first got into crypto with Coinbase.
It's the same account that payroll would direct deposit my paychecks to when I worked at Coinbase.
Please explain to me how blocking access to my account for 2 months is protecting me because I can't get any support information or support from your support team.
Might be time to update your system.
youd have empathy for bankless too if you had ever been pushed around the internet by the crypto-illiterati spewing their uninformed bullshit!
bullshit asymmetry principle - the amount of energy needed to refute bullshit is an order of magnitude bigger than that needed to produce it.
getting hit with a torrent of asymmetric bullshit is like a DDOS attack. i know because it has happened to me @gitcoin like a dozen times. every time we die, every time we come back stronger. sometimes its our fault, sometimes its not. sometimes we have something to learn, sometimes not. - but the origin of the controversy is never malicious and usually the audience isnt aware of the tradeoffs involved.
each time some portion of the community leaves us behind not caring what really happened or why.
literally impossible to steer a team through a bullshit hurricane where no one cares about truth or nuance + all we care about is easy dunks & viral hot takes. this last week has been conflict entrepreneurship at its worst!
this isnt really about bankless for me, its about our ragebaiting information environment. if you care about anti authoritarian tech you should care how we sensemake in decentralized/democratic ecosystems in the 21st century.
for me that means, i try and be someone who does a little research before i speak. and to be someone who constructs more than i destruct...
1 year ago we told an “investor” how we incorporated FPGA’s on device (edge) for AI based processing at the edge. We sent them devices to test, they ghosted us and are now the talk of DePIN for their “Edge AI” network 😂
@uncertainvector There are plenty of solid ID systems, almost all drones RTH so it’s just a case of tracking via radar if they aren’t broadcasting RID or ADSB (or DJI packets).

Completely disagree with this. Read the comments.
"a category that a global community of entrepreneurs identifies with."—I don't think the Virtuals team identifies with being DePIN!
What about it is DePIN? Because the agents run on GPUs?
They don't have to run on physical GPUs they own, they can run on cloud GPUs and generally do. Or they can literally be Claude / ChatGPT with a custom system prompt + RAG. What about this is physical at all? DePIN implies a physical infrastructure network that is coordinated by crypto. None of that is in any way true for Virtuals. Nobody has to own any physical infrastructure, and they don't even imply that they do.
If "the ingredients for AI" intrinsically touch DePIN, then all blockchains intrinsically touch DePIN, because they all use energy (PoW), compute (SC platforms), data (state, or Celestia?), bandwidth (every P2P network).
This is clearly not what people mean by DePIN. Language means what people mean by it, and people don't think AI agent launchpads are DePIN.
