A candidate appearing for an examination in a bona fide manner—or submitting a bona fide report regarding unfair means—does not face penal action under the Act, unless found involved in “unfair means” relating to the conduct of a public examination.

What constitutes “unfair means” in a public examination?
The Act covers practices including question paper/answer key leaks, unauthorised assistance, tampering with answer sheets or computer systems, manipulation to facilitate unfair means, fake websites, fake exams and fake admit cards or offer letters.

Who and what are covered under the Act?
The law covers persons/groups, service providers, senior managerial personnel of service providers, institutions and public servants. It applies to examinations conducted by UPSC, SSC, RRB, IBPS, NTA and other specified authorities.
All types of examinations including pen-and-paper, OMR and computer-based exams are covered.
