This is going to have a chilling effect on copyright. If generated content avoids more lawsuits than human content, then generated content is lower risk.

"But I could have made this picture with AI" is not a copyright defense that works.

A blogger was sued for copyright infringement for using the image below on their blog. The photographer sued.

It's true that if the blogger had just prompted a similar image, they probably would have been fine.

But "could have" does not save the day:

"Defendant asks the Court to rule, without any legal support, that copyright does not protect works which could have been generated with AI.

Such a holding would destroy the foundations of copyright law.

The Court declines to endorse or entertain this proposition."
