Employers Employing Illegal Foreigners Could Face Fines of Up to R100,000 Per Undocumented Worker as Government Intensifies Crackdown on Illegal Employment and Immigration Violations
Deputy Employment and Labour Minister Jomo Sibiya says employers found hiring undocumented migrants could face fines of up to R100,000 per worker under new government enforcement plans. The measures follow President Cyril Ramaphosa’s announcement of stricter penalties and possible imprisonment for violations of the Immigration Act.
Speaking to Newzroom Afrika, Sibiya said the Department of Employment and Labour is also recruiting 10,000 labour inspectors to strengthen workplace enforcement and identify employers hiring undocumented foreign nationals. He said this is part of efforts to close legal gaps and improve compliance as immigration and labour conditions continue to evolve.
The department currently has about 2,300 inspectors, with recruitment now underway to expand capacity. Sibiya said inspectors will work with the Department of Home Affairs and SAPS to identify undocumented workers in workplaces, while deportation processes remain under separate authorities. He also confirmed plans for tougher penalties and criminal charges.
He added that inspectors would target employers exploiting undocumented labour for cheap wages and higher profits, and said enforcement operations are ongoing nationwide. Sibiya confirmed he will lead a major inspection operation in one province on Wednesday as part of continued government action on immigration enforcement.
