Yahya ibn Aktham (Allah's curse be upon him) tries to test Imam al-Jawad (peace be upon him) in the presence of the Abbasid ruler al-Ma'mun (Allah's curse be upon him) - with a single answer from the Imam the matter ends with the complete helplessness and failure of Yahya ibn Aktham, and al-Ma'mun was left like the idiot, begging for clarification of the issue because of the Imam's sharp insight and intelligence while he (the Imam) was only nine years old!
The Abbasids unanimously agreed to choose Yahya ibn Aktham, the Chief Judge of Baghdad and one of the leading scholars of jurisprudence among the Nasiba in that era, to test Imam Abu Ja'far the Second (peace be upon him). They presented the matter to him and promised him immense wealth if he tested the Imam and he was unable to answer, for that would achieve for them the greatest of victories.
They wanted to test Imam al-Jawad (peace be upon him) with the intention of overcoming him before the people and the Abbasid ruler and invalidating his Imamate and legitimacy out of hatred for Muhammad and the family of Muhammad. Imam al-Jawad (peace be upon him) at that time was nine years old.
Al-Ma'mun ordered that a cushion be spread for Imam Abu Ja'far the Learned and that two bolsters be placed in it for him. That was done for him and the Imam sat in it. Yahya ibn Aktham sat before him, and al-Ma'mun sat on a cushion connected to the cushion of the Imam.
Yahya ibn Aktham asked the Imam: What do you say, may Allah make me your ransom, about a person if he hunted in Ihram?
The Imam answered by asking Yahya: Which branch of it does he mean?
Did he kill it outside the sanctuary or inside the sanctuary? Was the person in ihram aware or unaware? Did he kill intentionally or by mistake? Was he free or a slave? Was he young or old? Was it his first time killing or a repeated act? Was the animal a bird or something else? Was it a small animal or a large one? Was he persistent or remorseful? Did he kill it at night or during the day? Was he in ihram for umrah when he killed it, or was he in ihram for hajj?
Did he kill it outside the sanctuary or inside the sanctuary? Was the person in ihram aware or unaware? Did he kill intentionally or by mistake? Was he free or a slave? Was he young or old? Was it his first time killing or a repeated act? Was the animal a bird or something else? Was it a small animal or a large one? Was he persistent or remorseful? Did he kill it at night or during the day? Was he in ihram for umrah when he killed it, or was he in ihram for hajj?
Yahya found himself incapable and ignorant of the amount of detail and precision in such a legal matter that had never come to him despite his planning. He failed, and al-Ma'mun became bewildered and was left like a fool by the Imam’s intelligence and vast knowledge that encompassed every detail of the issue. So al-Ma'mun asked Imam al-Jawad (peace be upon him) for clarification, and the Imam replied:
If a person in ihram kills a wild animal outside the sanctuary and the animal is a large bird, then he must offer a sheep. If he kills it inside the sanctuary, then the compensation is doubled. If he kills a fledgling outside the sanctuary, then he must offer a young lamb that has been weaned from milk, and he does not have to pay its value because it was not in the sanctuary. If he kills it inside the sanctuary, then he must offer the lamb and the value of the fledgling.
If it is a wild animal, then for a wild donkey he must offer a cow. If it is an ostrich, then he must offer a camel. If he cannot, then he must feed sixty poor people. If he cannot, then he must fast eighteen days. If it is a cow, then he must offer a cow. If he cannot, then he must feed thirty poor people. If he cannot, then he must fast nine days. If it is a gazelle, then he must offer a sheep. If he cannot, then he must feed ten poor people. If he cannot, then he must fast three days.
If he killed it inside the sanctuary, then the compensation is doubled as a sacrificial offering reaching the Kaaba, a binding obligation that he must slaughter if he is performing hajj at Mina where the people slaughter. If he is performing umrah, he must slaughter it in Mecca in the courtyard of the Kaaba and give in charity the equivalent of the price of a sheep.
If he kills a pigeon from the pigeons of the sanctuary, then he must give one dirham in charity and one dirham to buy feed for the pigeons of the sanctuary. For a fledgling, half a dirham, and for an egg, a quarter of a dirham.
Everything that the person in ihram does out of ignorance or by mistake carries no penalty except hunting, for in that there is ransom whether it was done in ignorance or knowingly, by mistake or intentionally.
Everything done by a slave, its expiation is upon his master like what is binding upon his master. If he points to a wild animal while in ihram and the animal is killed, then he must offer ransom for it. The one who persists in it incurs, after the ransom, punishment in the Hereafter, while the remorseful one has nothing upon him in the Hereafter after the ransom.
If he kills at night or unwillingly by mistake, then there is nothing upon him unless he deliberately hunts. If he hunts at night or during the day, then he must offer ransom for it. The one in ihram for hajj slaughters the ransom in Mecca.
