An important judgment has been delivered clarifying the limits of new protest legislation.
Partner and Head of our Criminal Defence team, Raj Chada, successfully represented members of Animal Rising in the Supreme Court. The case considered the scope of public nuisance offences under the Police, Crime, Sentencing and Courts Act 2022, following a protest outside the Müller Dairy site near Droitwich in September 2022.
The Court considered whether access over a private road could amount to "a right that may be exercised or enjoyed by the public at large" for the purposes of public nuisance legislation. The Supreme Court concluded that it could not. A private road is not a highway, and the public at large has no general right to use it. As a result, the prosecution's interpretation of the legislation was too broad.
This judgment provides valuable clarification on the limits of protest-related offences and the proper interpretation of the law.
