Netanyahu Cancels Testimony at Last Second, War Looms as His Final Legal Hail Mary

On October 22, 2026, Netanyahu was supposed to attend Mandelblit's testimony. He withdrew at the last moment. The cancellation fits a well-documented pattern. Since 2020, his legal team has filed at least 18 requests to postpone hearings on "national security" grounds. Wartime developments have repeatedly interrupted the trial.

The most direct way a new war would help Netanyahu is by triggering a legal state of emergency that automatically pauses or disrupts judicial proceedings. This is not hypothetical. When Israel declared a state of emergency during the war with Iran, the justice system entered "wartime mode" and the trial effectively froze. When a ceasefire led the emergency to be lifted, the court immediately announced proceedings would resume. Within hours, Netanyahu's lawyers filed another postponement request. This is a "procedural delay" pattern. Every time the trial gains substantive momentum, a "national security" justification halts it again. A new war would reset the cycle. It would give the defense a fresh, concrete security rationale to argue that Netanyahu cannot be in court while the country is under threat. During active hostilities, that claim is harder for judges to reject outright than during a routine security schedule.

War also serves a political and media function. The conflict with Iran and other fronts is a "smokescreen" for the trial. It shifts public attention away from corruption proceedings and toward security affairs. That matters in two ways. First, public opinion management. During wartime, the public's psychological expectation is that the leader should be "focused on security," not defending himself in court. Postponements then seem reasonable rather than evasive. Second, narrative control. Netanyahu has consistently framed the charges against him as political persecution. A war lets him occupy the role of wartime leader, a figure whose legal troubles are framed as a distraction from the national mission rather than a legitimate accountability process.

Then there is the election. The timing is critical. The October 27 election is five days away. If Netanyahu can use a new war to push the trial past that date, the calculus changes fundamentally. If he wins re-election, his political mandate could be used to argue for a broader settlement of the legal cases, or to pursue pardon avenues from a position of electoral strength. If he loses, the legal shield collapses. That is precisely why the war option is most valuable to him before the vote. Stopping the fighting means restarting the trial. That is a key reason Netanyahu has an incentive to keep military operations alive through the election period. A new war would be the most dramatic way to secure that bridge.

But a new war is not a guaranteed win for Netanyahu. The risks are growing. Opposition leader Yair Golan has explicitly stated that Netanyahu "completely lacks the legitimacy" to launch a new war on the eve of elections. He accused Netanyahu of being willing to "put Israel's security at risk to save himself." That framing, that the war is a personal legal tactic rather than a national necessity, is a potent political weapon. External constraints matter too. The Financial Times reported that Trump rejected a planned strike by Israel on Iran that was reportedly set to begin on October 10, partly out of concern for US midterm elections. A new war requires US acquiescence. That support is not unconditional. Then there is judicial fatigue. The courts have already rejected "dozens" of postponement requests throughout the war. Judges may become increasingly skeptical of security-based claims that coincide precisely with critical testimony dates, especially when the security justification appears to function as a recurring "switch" that can be turned on and off. And there is the ceasefire trap. If a war begins but ends quickly, or if a ceasefire is imposed, the trial resumes immediately. Netanyahu is back in court with the added political damage of having launched a conflict that critics will call a legal maneuver.
