Apparently, we are not supposed to rewrite the Constitution but only amend it. 😂
Today’s discussion raised an interesting question: if certain provisions cannot be touched because they have already been interpreted or ruled on by the Constitutional Court, then what exactly is the purpose of this review process?
Surely one of the reasons people propose amendments is to clarify wording, close loopholes, and remove ambiguities that have led to interpretations they disagree with.
We were told that provisions such as “every child has a right to education” are rooted in international instruments, including the 1951 UN Convention, and therefore cannot simply be changed.
The @EFFSouthAfrica representative argued that South Africa cannot isolate itself from the international community and must remain aligned with its international obligations.
@Mngxitama2 then posed a question that many South Africans may be asking: if public submissions can be dismissed as unconstitutional and rejected by the legal team, what is the actual purpose of the Constitutional Review Committee? He argued that it cannot be correct for the concerns and proposals of citizens to be set aside on that basis alone.
A fair question remains: if some parts of the Constitution are effectively beyond the reach of public amendment proposals, what exactly are South Africans being invited to review?
