Is the Enforcement Directorate (ED) crossing the line between investigation and intimidation?
A recent Delhi High Court judgment has reignited concerns about the misuse of investigative agencies and the impact such actions can have on press freedom and dissent in a democracy.
While quashing the money laundering proceedings against NewsClick and its founder, Prabir Purkayastha, the Court made strong observations, describing the case as a mala fide exercise and an arbitrary attack on free and independent journalism.
According to the judgment, despite nearly 18 months of investigation, multiple raids, repeated summons, and extensive questioning, the ED failed to place any incriminating material on record. The Court further noted that the investigation had turned into a "fishing and roving inquiry" — a search for evidence without a solid foundation to begin with.
The case was built around allegations relating to foreign investment and FDI violations. However, the Court found that the very foundation of the scheduled offence was missing. And without a valid predicate offence, the money laundering case could not survive.
