When did it become an act of courage for a nurse to call a man a man? When did stating biological reality transform from common sense into career-ending heresy? And when, precisely, did the institutions claiming to protect working-class women decide their dignity was worth less than an ideological abstraction?
The Supreme Court answered these questions in April 2025. Five judges, unanimous, declared what everyone from your grandmother to the bloke down the pub already knew: in the Equality Act 2010, “woman” means biological woman. “Man” means biological man. The law, at least, still recognises material reality.
Jennifer Melle has just been reinstated. After nine months suspended on full pay. After being escorted from her workplace. After a disciplinary hearing that quietly concluded there was no evidence the patient had been identified. After a national campaign, political intervention, and tens of thousands of petition signatures. She won.
But she never should have had to fight.
Her case, alongside Sandie Peggie’s partial tribunal victory and the Darlington Eight’s landmark win, exposes something rotten at the heart of our public institutions. This is not about compassion, inclusion, or progressive values. This is about power: who wields it, who benefits from it, and who pays the price when working-class women dare to say “no” to those who demand their compliance.

The way Epsom & St Helier University Hospitals NHS Trust have treated Jennifer Melle is even worse than we knew.
First, they offered her absolutely no support for having been the victim of racial ab*se by a gigantic convicted p*edophile who tried to headbutt her, instead launching straight into attacking her for "misgendering" him.
Then they moved her & isolated her, not allowing her to mix with the other nurses in the staff room, forcing her to often eat lunch alone on a grassy area outside.
All of this understandably took a toll, & Jennifer was signed off sick. When she returned to work, they had put someone else in her role & told her she would need to reapply, resulting in Jennifer having to take a job at a lower nursing grade just to keep working.
'“I felt like I was going through torture,” she said.'
I am not surprised, what they did to her despicable.
I don't care that it is public money, I hope the Trust have to compensate Jennifer very handsomely, & that they learn that they can NEVER treat another nurse like this again.
I spoke to the BBC about the recent employment tribunal decisions in Peggie v NHS Fife and Hutchinson v Darlington NHS Foundation Trust, two cases which found sex-based harassment arising from permitting trans women to use female-only changing rooms. If govt is waiting for judgment in the Good Law Project JR against the EHRC’s interim update, I wonder if they intend to wait until all avenues of appeal in that case have been exhausted. That could be 3+ years down the road..../1
