Should you sign a document before taking it to a Notary?
It depends on the type of notarization you need. For an acknowledgment, the document may generally be signed before you appear before the Notary because you are acknowledging that the signature is yours. For a jurat, you must sign the document in the Notary’s presence after taking an oath or affirmation.
If you don’t know which notarization your document requires, don’t guess. The Notary generally cannot choose the notarization for you because that could be considered the unauthorized practice of law.

Can you use an expired ID for notarization in Illinois? 🚫 The answer is no — Illinois requires an acceptable, current form of identification when ID is used to identify a signer.
But an expired ID doesn’t necessarily mean the notarization can’t happen. Illinois Notaries may have other options for identifying a signer, including personal knowledge or an eligible credible witness, when the requirements are met.

🚦 RED LIGHT or GREEN LIGHT? 🚦
An adult child brings their elderly parent in to sign a trust amendment, but the parent seems confused, forgets why they’re there, and looks to their child for every answer. Then, when asked whether they understand the document, the child jumps in: “Yes, she knows. Mom, just sign where the arrow is.” 😬
What would you do: 🛑 stop or 🟢 proceed?
The answer: RED LIGHT. 🚨 A signer must appear willing and aware of what they are signing. If you have concerns, ask to speak with the signer privately, and if you still are not satisfied, you may need to refuse the notarization.
Most important: document the situation in your journal. 📝
Notaries, your role matters. Protect the signer, protect the integrity of the notarization, and never ignore the red flags. 💪⚖️
