Typically, yes. However, in this case Cohen was charged with a felony because not only did he break the law, he knew he was breaking the law and sought to cover it up.
What's the biggest takeaway from Florida's recount?
Florida needs to update it's election standards, process, and equipment. I'm skeptical the incoming administration will make this a priority. I think at the very least counties should agree on a standardized ballot template.

@RoigFranzia Broward is trying to save face saying it wasn't ballot design, but I don't buy it. Broward's undervote for Senate was a massive outlier. I don't doubt some people skipped on purpose, but there's no reason to believe that explains all 30,000 undervotes.
@PaulGonzalez10@harrisalexc Also, apparently in Duval they only have green markers at the tables so there's no way to change/add a vote. Other counties likely have similar policies.
@PaulGonzalez10@harrisalexc There are multiple people assigned to each table and there is always at least one Nelson and one Scott person. The room is also full of press and lawyers from both campaigns.
@1200WOAI Your tweet is incorrect. Palm Beach had an incomplete vote count. Broward met the deadline.
Susan Bucher is Palm Beach's Election Supervisor and Brenda Snipes is Broward's Supervisor.
@ConnorofKane @nprpolitics@asmamk Their machines broke down. They flew in new ones but still weren't able to get them operational in time. Once the deadline extension was denied, the Supervisor sent her tech staff home because they had literally been there for 42 hours straight trying to meet the deadline
@MrTravoli @Jim_Rebuff@tamaragitt Technically, Bush didn't win the recount, he won based off the initial results. Bush v. Gore stopped the recount and, by default, the initial result stood.
