Last weekend, the Court of Appeal hosted the second Rosenberg Mentorship Moot. Inspired by the Hon. Marc Rosenberg -- a judge on the court from 1995 to 2015 -- the moot pairs junior counsel with experienced Crown & defence mentors. Participants argue a mock criminal appeal before Court of Appeal judges and special guest judges. For the first time this year, the moot included an opportunity to argue the mock appeal in French. Congratulations mooters and thank you mooters, volunteers, organizers, and judges!

Tomorrow the Court of Appeal will begin three days of hearings in the Government of Ontario’s reference to this Court asking for an opinion about permitting international play in an online provincial lottery scheme.

The reference will be heard by a panel of five judges, including the Chief Justice. The Court has been asked for an opinion on the question:

“Would legal online gaming and sports betting remain lawful under the Criminal Code if its users were permitted to participate in games and betting involving individuals outside of Canada as described in the attached Schedule [to the Order-in-Council]? If not, to what extent?”

The online gaming reference will be heard by the Court of Appeal from November 26-28, 2024.

Earlier this month, the Court of Appeal travelled to Ottawa to meet with judges from the Superior Court of Justice and Ontario Court of Justice in the eastern region. The Court also spent time with the local bar and with law students and faculty from the University of Ottawa.

At @uOttawa , Chief Justice Michael Tulloch reflected on the university’s important contributions to the justice system and encouraged its professors and law students to continue to make a positive difference bridging the gap between law and technology and tackling emerging issues in public law, to name just two of the university’s areas of focus.

ICYMI, the 2024 Opening of the Courts of Ontario ceremony was held Monday afternoon.

During his remarks, Chief Justice Michael Tulloch said the gathering was an opportunity “to reaffirm our commitment to a strong and independent judiciary; to redouble our promise to enrich and enhance public confidence in the administration of justice; and to reassert our pledge to uphold the rule of law for the people of Ontario.”

The Chief Justice also remarked on the collaboration of all those involved.

“Simply put, we do not do this alone. We gather together alongside the Attorneys General, members of the bar, and the public to underscore the openness of the courts and to emphasize that these courts do not belong to us. We are their stewards, with a duty to serve the public. First and foremost, we are a people centred court.”

❗️📢 REMINDER: 2024 Opening of the Courts of Ontario

The Opening of the Courts of Ontario ceremony for 2024 will be held on Monday, September 23, 2024, at 3:30 pm.

The ceremony will feature remarks from the Chief Justice of Ontario and President of the Court of Appeal Michael Tulloch, Chief Justice of the Ontario Superior Court of Justice Geoffrey Morawetz, and Chief Justice of the Ontario Court of Justice Sharon Nicklas.

Chief Justice Tulloch will also present the annual Catzman Award for Professionalism and Civility.

The Court of Appeal wishes Justice Mary Lou Benotto all the best in her retirement from the bench! Justice Benotto was called to the bar of Ontario in 1978. Appointed to the Superior Court in 1996, she served as a judge for 28 years, 11 years on this Court. An extraordinary jurist who left an indelible mark on the Canadian judiciary, Justice Benotto was also the longest serving chair of the Court of Appeal’s family rules committee. Her last official day was August 30, 2024.

Starting this morning, the Court of Appeal will hear five days of live evidence as part of an appeal in R. v. Timothy Rees.

Mr. Rees was convicted of second-degree murder in 1990. All appeals were exhausted.

In 2023, the federal Minister of Justice accepted Mr. Rees’ 696.1 application for criminal conviction review and referred the case to the Court of Appeal for Ontario. (https://t.co/x89GiR4CdG)

Fresh evidence on the appeal will be heard live from June 24-28.

The hearing of the appeal on the merits will happen at a date to be determined.

The Court of Appeal congratulates former COA research lawyer and now Justice Courtney Harris on her appointment to the Ontario Court of Justice. Called to the bar in 2003, Justice Harris has been a private sector litigator, Crown counsel at the Ministry of Labour and the Ministry of the Attorney General, counsel for the Office of the Children’s Lawyer, and – most recently – a research lawyer at the Court of Appeal for Ontario. She has been assigned to Chatham. Congratulations Justice Harris!

Osgoode Hall hosted #DoorsOpenToronto this past weekend, and thousands visited its historic courtrooms.
