BREAKING: HELL YEAH! A federal judge invokes the legacy of the late Dolly Parton in his ruling to overturn Texas's hateful ban on harmless drag shows.
The Queen of Country is smiling down from heaven over this one...
“There are ‘erotic’ elements in countless popular performances that could be subject to both civil and criminal penalties under S.B. 12,” wrote U.S. District Judge David Hittner, referring to Texas Senate Bill 12, a 2023 law aimed at drag shows.
“Because S.B. 12 does not specify who determines whether a performance 'appeals to the prurient interest,' or require that the work be taken as a whole, a single moment of eroticism could condemn an entire performance to criminal or civil penalties,” he continued, before pointing out that some critics attacked Dolly Parton “as a voluptuous sex symbol because of her big hair, flamboyant clothes and breast exposure.”
The judge ruled the ban unconstitutional under the First Amendment because it's a clear cut case of restricting free speech. As written, it allowed the government to fine business owners $10,000 for hosting drag shows and also carried a possible one-year jail sentence for performers involved in such shows.
He also pointed out that the law was so sweeping that it could be interpreted as a restriction on “cheerleading, dancing, live theater, and other common public occurrences."
The ruling comes as a major blow for the state's corrupt attorney general Ken Paxton, the man running against Democrat James Talarico for the U.S. Senate, because Paxton would love nothing more than to pander to the bigoted MAGA base by aggressively targeting the LGBTQ community.
“Finally, for those who find such activities as described in this case offensive,” the judge added. “The solution is relatively simple ... just don’t go.”
We couldn't agree more! We also know that Dolly Parton, a longtime supporter of the LGBTQ community and an outspoken advocate for gay marriage and transgender rights, would be thrilled to be connected to this ruling.
