Theres a broad, bipartisan effort to finish and pass the Clarity Act when the Senate returns from break for their scheduled cloture vote.
The SEC and CFTC will create the same “clarity” if legislators abdicate their responsibility, but I/others still have faith in Congress too
I expect over the coming weeks/months we'll see issuers rethink products to conform with these rules,
New products will be designed and launched
And we'll get glimmers of the tokenized future; more transparency, 24/7 trading, less intermediaries, and a self-sovereign future.
🚨 TODAY: The SEC issued an order granting temporary, conditional exemptive relief to Tokenized Securities Venues from the definition of “exchange” in the Exchange Act to trade tokenized NMS stock using innovative permissioned automated market makers and liquidity pools.
@SECPaulSAtkins This 5-year program will allow tokenized stocks to trade on AMMs (@Uniswap, @orca_so). Important conditions:
- NMS stocks can trade onchain
- The market has to be permissioned
- An issuer can opt-out of a 3rd-party token (e.g. wrapper)
- The exchange has to adhere to halts (?)
The Clarity Act failing today makes everybody a loser, all because partisan jockeying beat out common sense:
The lines between tokens and securities are no more clear.
Entrepreneurs will still prefer to build and raise capital offshore.
Investors will receive no more information, or protections.
Developers have no additional safeguards for decentralized systems.
Banks are stuck with stablecoins able to pay rewards (yield).
There are zero ethical guardrails for government employees and crypto.
The list goes on.
But mostly I just feel for the countless folks in the industry and across the House and Senate (of both parties) that worked on this for so long, and the light of American leadership dimming just a tad.
Onwards
Senators that vote FOR the Clarity Act today demonstrate that they are on the side of consumers, technological innovation, and regulation.
Senators that vote AGAINST the Clarity Act today demonstrate that they are for the unregulated, swampy status quo.
Simple as that.
