आपातकाल के दौरान संसद का कार्यकाल पाँच वर्ष से बढ़ाकर छह वर्ष कर दिया गया। उस समय जब देश के प्रमुख विपक्षी नेता जेलों में बंद थे, 42वाँ संविधान संशोधन पारित किया गया।

इसी दौर में, जब लोकतांत्रिक विरोध की आवाज़ें कैद थीं, संविधान की प्रस्तावना में “समाजवादी” और “पंथनिरपेक्ष” जैसे शब्द जोड़े गए।

जनप्रतिनिधित्व अधिनियम में भी ऐसा संशोधन किया गया, जिसे पूर्वव्यापी प्रभाव दिया गया, ताकि प्रधानमंत्री के चुनाव को किसी भी न्यायालय में चुनौती न दी जा सके।

चूँकि कानून को पहले ही बदल दिया गया था, इसलिए सर्वोच्च न्यायालय की भूमिका भी सीमित हो गई।

यह वह समय था जब आपातकाल के नाम पर लोकतंत्र की मूल आत्मा को गहरी चोट पहुँची।

इलाहाबाद हाईकोर्ट ने इंदिरा गांधी का चुनाव निरस्त कर दिया था। इसके खिलाफ इंदिरा जी सुप्रीम कोर्ट गईं, लेकिन उन्हें पूर्ण राहत नहीं मिली।

जब यह घटनाक्रम हुआ, तब इंदिरा गांधी को बचाने की कोशिशें शुरू हुईं और इसी क्रम में आपातकाल लगाया गया।

ध्यान रखिए, इंदिरा गांधी की कुर्सी बचाने के लिए ही आपातकाल लगाया गया था।

The Representation of the People Act was amended with retrospective effect so that no legal challenge could be made against the Prime Minister's election.
The Supreme Court could do nothing because the law had already been amended.

Democracy was murdered during the Emergency.
