نداء لإلغاء “قانون قيصر” ودعم تعافي سورية واستقرارها

السادة الكرام،

نحن، المنظمات الأمريكية السورية الموقعة أدناه، نحثّ الكونغرس على أن يحرصَ على أن يتضمّن التقرير النهائي للجنة المؤتمر الخاصة بقانون تفويض وزارة الدفاع للسنة المالية ٢٠٢٦ البندَ الذي أقرّه مجلس الشيوخ برعاية من السيناتورة جين شاهين والسيناتور راند بول، والذي يقضي بإلغاء قانون قيصر لعام ٢٠١٩ بشكل كامل ودائم وغير مشروط.

لقد سُنَّ قانون قيصر في الماضي للضغط على نظام متوحّش لم يعد موجوداً اليوم. لذا فإنّ الاستمرار في تطبيق العقوبات الثانوية التي يشتمل عليها هذا القانون لا يؤذي الشعب السوري فحسب، بل ويضرّ بالمصالح الاستراتيجية والسياسية والتجارية للولايات المتحدة. إن الإلغاء الذي تضمّنه مشروع قانون موازنة وزارة الدفاع، والذي أقرّه مجلس الشيوخ مؤخّراً، يُعدّ تصحيحاً طال انتظاره لهذا المسار، وإنّنا نحضّ مجلس النواب على إقراره في النسخة النهائية من التشريع.

لقد دعت جاليتنا الحكومة الأمريكية وحلفاءها منذ سقوط بشار الأسد في كانون الأول ٢٠٢٤ وحتى اليوم إلى رفع العقوبات والقيود على الصادرات التي فُرضت بسبب حرب النظام البائد على الشعب السوري. اذ أنّ هذه الإجراءات اليوم تعرقل جهود التعافي والمصالحة الاجتماعيّة، وتضرّ أيّما ضرر بجميع السوريين، لا سيّما الأقليّات منهم التي ترغب في البقاء في وطنها – إذ يحتاج جميع المواطنين اليوم إلى الاستقرار والفرص الاقتصادية بشكل إسعافي. كما تُثني هذه العقوبات الشركاء الإقليميين والمغتربين السوريين عن المساهمة في إعادة الإعمار، وتمنع الشركات الأمريكية من المشاركة في مشاريع التعافي، ما يخلي الساحة للمنافسين الصينيين. وباختصار، فإنّ هذه القيود تخنق المبادرات الضرورية لاستعادة الاستقرار وإعادة بناء البنية التحتية وبثّ الحياة في المجتمعات المحليّة.

وعلاوةً على ذلك فإن إلغاء قانون قيصر هو أيضاً مسألة تتعلق بالمصلحة الوطنية الأمريكية. فالعقوبات الحالية تعيق التعاون الضروري في مجال مكافحة الإرهاب بين المؤسسات الأمريكية، بما في ذلك وزارة الدفاع، والحكومة السورية. ومع استمرار وجود هذه التهديدات في المنطقة، فإنّ من الضروري أن تمنح القوانين التي يسنّها الكونغرس الوكالات الأميركية المرونة اللازمة للتنسيق الفعّال مع نظرائها السوريين للعمل على الأهداف الأمنية المشتركة.

ويجدر بالذكر هنا أنّ كبار المسؤوليين الأميركيين يشاركوننا هذا الرأي، فقد دعا المبعوث الأمريكي الخاص لسورية السفير توم براك، مؤخراً الكونغرس إلى إلغاء قانون قيصر، مشيراً إلى أن ذلك سيوائمُ الواقع كما هو على الأرض مع تطلعات منطقة تصبو إلى طيّ صفحة الماضي. كما نوّه السفير إلى أن ستةً وعشرين من كبار رجال الدين المسيحيين في سورية قد ناشدوا الكونغرس لإنهاء العقوبات، محذّرين من أنها أضحت الآن “أحد الأسباب الرئيسية لانكماش الوجود المسيحي في وطنهم”.

إنّ من شأن رفع هذه العقوبات أن يسهّل العودة الطوعية والآمنة للاجئين من خلال توطيد أركان عملية إعادة الإعمار وخلق فرص العمل وإصلاح البنية التحتية – وهي شروط لا مندوحة منها لتمكين السوريين النازحين من إعادة بناء أحيائهم وتخفيف العبءِ عن الدول التي تستضيفهم.

ومن المهمّ التأكيدُ على أن سورية لا تطلب المساعدات أو الصدقات. فالسوريون مصممون على إعادة بناء وطنهم بجهودهم الذاتية، ولكن العقوبات الأمريكية الحالية تحرمهم من الحصول على الأدوات والمواد والاستثمارات اللازمة للقيام بذلك. لذا فإنّ إنهاء هذه القيود سيمكّن السوريين من تحقيق الاكتفاء الذاتي والاستقرار – وسيجنّبهم الحاجة للاعتماد على الغير.

إنّ لدى الولايات المتحدة فرصة تاريخية اليوم لمساعدة سورية على النهوض من أنقاض الحرب. وقد انتفى المبرّر للإبقاء على العقوبات الاقتصادية المدمّرة بعد رحيل الأسد، لذا فإنّ من شأن إلغاء قانون قيصر أن يبرهن أن الكونغرس مقرٌ بهذه الواقع الجديد ومستعدّ لدعم سورية وأمنها واستقرارها بحيث تصبح قادرةً على الاعتماد على نفسها.

وبناءً عليه، فإنّنا نهيبُ بكم على أن تحرصوا على أن يتضمّن قانون تفويض الدفاع الوطني للسنة المالية 2026 البند الذي (يُتبع أدناه في التغريدة ٢) 👇🏼
