A couple of weeks ago, the Supreme Court handed down Montgomery v. Caribe Transport II in a unanimous ruling. Freight brokers in the U.S. can now face state-law negligent-selection claims when they choose unsafe trucking fleets to move loads. The old FAAAA preemption argument is no longer a complete shield for safety-related broker negligence claims.
Justice Kavanaugh put the issue simply: federal law requires brokers to select a federally registered carrier, but does not require much more today to evaluate carrier safety. If state tort claims were also preempted, brokers could operate in a “black hole” with no meaningful safety-related oversight. The Supreme Court just closed that gap.
This is not a small corner of transportation. The U.S. has more than 2 million registered motor carriers in Federal Motor Carrier Safety Administration's (FMCSA) system, nearly 580,000 active U.S. motor carriers that own or lease trucks, and roughly 25,000 active freight brokers.
We have been saying for years that every commercial auto policy will eventually come with a baked-in telematics product. Montgomery may be one of the forcing functions to gets us there.
Freight brokers will need real safety data to defend carrier selection — not just lagging FMCSA scores. Truckers will adopt telematics faster because that data helps them win loads from brokers who now have greater liability exposure. And insurance will increasingly reprice the whole stack on the back of that data in real time.
This is a major catalyst to move the industry forward massively: safer roads, better fleets, smarter insurance, all powered by AI.
