Two adults go to a club, drink freely, both become intoxicated, somehow make their way home, and end up being intimate with each other. The next morning, however, the woman claims not to remember what happened, alleges that she was taken advantage of, and proceeds to sue. The court, of course, takes her side.

Women enjoy the same rights as men, as they should. But when it comes to accountability, why does the law sometimes seem to treat women as though they have no agency while placing a higher burden of responsibility on men?

If both adults were intoxicated, why is the man automatically expected to be responsible for the actions of both people? You’re drunk, I’m drunk, but somehow I’m the one expected to recognise that you are incapable of making decisions, reject your advances, and remain completely responsible while you are absolved of any responsibility.

If a woman is found drunk driving, she will be held responsible. If she commits a crime while intoxicated, intoxication does not automatically erase her responsibility. So why should the legal standard become completely different when sex is involved?

Shouldn’t the focus in such cases be on establishing the facts? Look at the circumstances surrounding the night. Check the bar bills, determine how much alcohol was consumed, examine available evidence, consider witness accounts, and, where possible, establish the level of intoxication of both parties. The question should be whether either person was actually incapable of giving consent, not simply whether one person later claims not to remember what happened.

Men need protection from false accusations and arbitrary assumptions too. The law should protect victims without presuming guilt based solely on gender, and it should hold people accountable based on evidence and the circumstances of each individual case.

At the end of the day, justice should be about establishing what actually happened, not automatically deciding who is responsible based on whether the accused is a man or the complainant is a woman.
