President Gatti Santana concludes her remarks at the #UNSC by extending her profound gratitude to the dedicated and exemplary #IRMCT staff, who continuously reaffirm their commitment to international justice.
#IRMCT President Gatti Santana underscores to #UNSC the importance of responsibly concluding the justice cycle. The “final phase of the justice cycle cannot be completed by relinquishing the guarantees that give international justice its legitimacy in the first place”
👉Retaining them at the international level – and specifically with the Mechanism – is the most cost-effective and efficient option and guarantees continuous oversight and consistent application of the law.
#IRMCT President Gatti Santana emphasises to #UNSC that international judicial authority should be maintained over a limited number of judicial functions, which are essential to the justice cycle and cannot feasibly be transferred to States or the UN Secretariat:👇
👉These limited functions relate to the transfer and release of prisoners, witness protection, non bis in idem, and the power to refer, monitor, and revoke cases.
👉Certain resource-intensive prosecutorial and judicial functions, including in-court proceedings, can be terminated or effectively carried out by States, if needed.
Next, President Gatti Santana presents to the #UNSC key proposals agreed by the #IRMCT Principals on the Mechanism’s future. These entail major changes to the Mechanism’s jurisdiction, operations, and physical footprint and propose the transfer of certain functions:
👇 The day-to-day supervision of conditions of imprisonment – which is largely administrative – can be transferred to enforcement States, provided that international standards are maintained.
# IRMCT President Gatti Santana highlights the contributions of the #ICTY, the #ICTR and the Mechanism to international justice, made possible through decades of multilateral cooperation. She notes that only limited, but still essential, work remains for the Mechanism.
