The Restore Patent Rights Act (H.R. 1574) claims to help inventors regain lost rights, but its use of the word “should” instead of “shall” effectively guts its impact. “Should” is merely a recommendation—it carries no legal force. This kind of language doesn’t advance real patent reform; it delays it.
The people crafting this bill are smart—this wording feels intentional. If we’re serious about restoring patent rights, this language must change.
