What happens when the Contractor never shows up to site?

Under the FIDIC Red Book 2017, the Commencement Date is more than a ceremonial milestone.

It’s a contractual turning point.

But when the Contractor fails to commence or mobilize with due expedition and without delay, the Employer faces serious questions:

- Can we terminate the contract immediately?
- Should we suspend first?
- What procedural steps must be followed?
- What if the Engineer delays issuing the Notice to Correct?

These aren't just academic questions.
They come up frequently in real projects — especially in:

- Donor-financed infrastructure programs
- Government-led housing or road works
- Fast-track or politically sensitive projects

To support project teams, I've attached a practical tool:

"Checklist: Suspension and Termination for Failure to Commence (FIDIC Red Book 2017)"

It helps you:

- Confirm breach of Sub-Clause 8.1
- Use suspension tactically (Clause 16.1)
- Follow proper steps under Clause 15.1 & 15.2
- Avoid missteps that weaken your legal position

Some people presume that having a hidden roof/low pitch roof for their structure will cut down drastically the roofing costs.

One has to think of the extra costs that come with doing RC Gutter Beam(s). DO NOT USE uPVC Gutters at any point on your hidden roof structure, otherwise you'll see bad thing as @kevinkamaumucha can attest on this.

Think of the costs of the concrete aggregates i.e. ballast, fine aggregates (river sand) and cement. Furthermore, the cost of reinforcement to be used plus the waterproofing aspect too.

It will save you a bit or not depending on how many RC gutter beams you have in your roof.

Next time you want to do a hidden roof, have this in consideration.

Contractors have the right—and the obligation—to object to Engineer’s instructions when those instructions create legal, technical, or financial risks.

Under the FIDIC 2017 Red Book, compliance isn’t automatic.

- If an instruction is unsafe, unclear, conflicts with the contract, or comes from an unauthorized party, the Contractor must formally object—before taking any action.

Here’s the reality many overlook:

- Proceeding without objection can lead to loss of time and cost entitlements, exposure to liabilities, and disputes you didn’t sign up for.

That’s why Sub-Clause 3.5 is critical.

It gives the Contractor the right to:

- Serve a formal Notice objecting to the instruction
- Demand clarification, confirmation, or modification
- Wait for a response within 7 days—or treat the instruction as revoked

How KES 1M invested in some financial assets would fair.

Do note the following:
1. The assets have different levels of risk hence diff returns. High risk = high return and the vice versa. Hence it’s unfair or misleading to only rank them on a return basis

2. Some assets like real estate, REITs, stocks, may have capital gains on top of cash flow generated hence full return not presented

3. I’ve only shared a list of cash generating assets. And other “speculative “ assets like crypto and commodities not included
