The idea that the holdout juror "refuses to follow the law" is total nonsense. They've been in there for like 40 hours. The guy obviously has not announced that he won't follow the law. He simply disagrees with the other jurors about where the application of the law should lead them in this case. The hectoring women on the jury interpret his disagreement as a defiance of the law itself.
@MattWalshBlog The problem is Mass. law requiring the State to prove beyond a reasonable doubt that Clancy was NOT temporarily insane. It is not like this in Alabama, the burden would be on the Defendant to prove that she was temporarily insane.
