After submitting the complaint to the concerned DCP, the next legal remedy is to approach the Court of the concerned Magistrate, seeking directions for registration of FIR against the accused persons.

Simultaneously, we will initiate contempt proceedings against the erring officials for non-compliance with the Order dated 28.04.2023 passed by the Hon’ble Supreme Court of India.

However the SHO of Parliament Street told the Court that Swatantra’s FIR is not among those that have been quashed by Supreme Court

मेरे जैसे लोग इतना कटु बोल कर भी केवल इसलिए बचे हुए हैं क्योंकि सरकार को लगता है कि अभी इसे उठाने का उचित समय नहीं है। जिस दिन उन्हें लगेगा, ऐसा हर व्यक्ति, ऐसे हर प्लेटफार्म से धीरे धीरे गायब हो जाएगा या मोदी चालीसा गाता हुआ वीडियो और पोस्�� डालने लगेगा।

मैं वैसे समय को लेकर चिंति�� हूँ क्योंकि तब सब कुछ समाप्त हो जाएगा। इसलिए आप चाहे मोदी के फैन हों, या आलोचक, सही को सही कहिए, ग़लत को ग़लत। किसी के बाप का यह देश नहीं है, देश हमारा है, आपका है और हमने किसी पार्टी को देश का संचालन करने दिया है, यह उनकी बपौती नहीं है।

Anticipatory bail has just been denied to @ajeetbharti in the case where the FIR against him invoked draconian SC/ST act provisions. Ajeet's remarks were a reaction to provocation involving his sister. He could be jailed for up to 7 years.

We have also filed the complaint against Sanjay Azad and Nishu Azad before the concerned DCP and apprised him of the Order dated 28.04.2023 in Ashwini Kumar Upadhyay Vs. Union of India & Ors., whereby the police is required to take suo motu action in such matters.

I have made it clear that, in the event the police fails to register the FIR, I may be constrained to initiate the following proceedings:

1. Petition under Section 175(3) BNSS / Section 156(3) Cr.P.C. seeking directions for registration of an FIR; and

2. Contempt proceedings against the erring officials for non-compliance with the directions contained in the Hon’ble Supreme Court’s Order.
