In a dramatic reversal for fed-up condo owners, a Miami-Dade judge has ordered the immediate removal of 1060 Brickell Condominium Association's incumbent board after it shamelessly clung to power for nearly a year—despite losing a state-mandated recall arbitration and illegally rejecting valid owner ballots that would have ousted them. The court confirmed owners secured 299 certified recall votes (2 over the required 297), proving the board’s attempts to invalidate ballots were unlawful, while exposing how the association wasted funds through ultra vires operations violating Florida’s Condominium Act—causing "irreparable harm" to residents. Ignoring a July state arbitration order and even trying to dodge accountability by scheduling a November election, the board’s last-ditch legal maneuvers failed as Judge Perkins slammed their "mootness" argument and gave them just 7 days (until Oct. 3) to surrender all records, keys, and finances to the democratically chosen new leaders: Dorinda Spahr, Jermaine Jones, and Javier Noriega—marking a hard-won victory for owners who fought relentlessly for nearly 12 months to end this abuse of power.

Since our board passed the now infamous illegal $21 million special assessment and even before then, we've been running a successful grassroots campaign to replace the board by all means available to us.
We went through all the hoops to collect enough signatures to have a @FloridaDBPR Ombudsman onsite to monitor on election day because we knew they don't play fair.
We've been collecting paper ballots because our board illegally eliminated electronic voting.
We've been working hard to collect every possible vote and get people to submit ballots in time because the board moved the election to Nov 30 on Thanksgiving weekend in order to ensure insufficient participation and get re-elected automatically, similar to last year when they moved it to the Christmas holiday.
The paper ballots were sent out at the very last minute, date stamped past our legally required deadline, and many owners never received their ballots at all.
All but one new candidate were inexplicably removed from the ballots that were sent without explanation or communication, reducing the options to the existing board plus one new candidate.
We decided push ahead in good spirits to encourage voting for the remaining new candidate and the two least bad choices remaining.
Many international owners are flying in for election day just to make sure their vote would count.
Today, after sufficient ballots were collected to change the board on Nov 30, they finally sent an email after close of business, canceling the entire election without explanation, and suddenly declaring unilaterally that the only remaining new candidate is disqualified from running, hoping for the current board to roll over into 2025.
