Article 92 of the 1995 Constitution establishes the principle of separation of powers and judicial independence by prohibiting Parliament from enacting laws that overturn court decisions and ensures that once a court has ruled on a matter, the decision remains final and cannot be undone through legislation targeting that particular judgment.
The idle NRM nincompoops should instead look at the UPDF Act, 2005, in its current form, and how it violates fundamental human rights guaranteed under Articles 24, 44, and 50 of our Constitution.
The lack of legal protection for officers who refuse unlawful orders encourages human rights abuses, including torture and extrajudicial killings. The deliberate failure to criminalise obedience to unlawful/arbitrary or stupid orders contradicts Ugandaโs international legal commitments.
How about these empty-headed parliamentarians look at amending the UPDF act to include in such safeguards?
