We can’t say we’re shocked that Andy Burnham has sacked Bridget Phillipson as Education Secretary.
One of her first acts as Secretary of State was to torpedo the Higher Education (Freedom of Speech) Act 2023 (HEFSA) — arguably the most consequential piece of free speech legislation in the past 15 years.
She reversed the commencement orders that would have brought the Act’s most important provisions into force, including the vital complaints scheme.
Rather than asking Parliament to do so, she bypassed it through ministerial fiat. The Free Speech Union challenged this in the High Court on two grounds: first, that it breached the sacrosanct constitutional principle that a minister cannot defy the will of Parliament; and second, that she had failed to carry out an adequate impact assessment.
Days before the case was due to be heard, Bridget Phillipson partially U-turned, announcing that she would commence most of the key provisions — and she duly did.
We then became embroiled in a long-standing dispute over who had won the case. That mattered because it determined who would pay the legal costs.
The High Court decided that the Free Speech Union had won and ordered the Government to pay our costs.
Importantly, when Phillipson announced her partial U-turn, the Free Speech Union offered to settle if the Government paid £80,000 — around a quarter of our total legal costs.
Pretty fair, no?
Well, the Government refused. The Free Speech Union believes this was because Phillipson did not want to admit she had reversed course.
The High Court has now ordered the Government to pay all of our costs. Bridget Phillipson’s hubris has cost taxpayers around £200,000. Combined with the Government’s own legal costs, the total bill exceeds £500,000.
That also means we now have the resources to challenge Phillipson’s successor, Lucy Powell, should she attempt to reverse any of the commencement orders that bring HEFSA into force — including the much-needed complaints scheme for academics, university staff and visiting speakers, which is due to come into force on 1 September.

As we mourn Ann Widdecombe’s untimely death, I am also thinking of David Amess, also brutally murdered in 2021 - I would say martyred. Two different personalities, but both committed & devout Catholics who lived & witnessed to their faith in the murky world of politics. They certainly emulated the legacy of St Thomas More, their patron, as they may have shared in his sacrifice. May the Lord reward them for their labours.

The Metropolitan Police has awarded Father Ted creator and Irish comedian Graham Linehan £25,000 and an unreserved apology after they arrested him last year as his plane touched down at Heathrow airport.
What was Graham's supposed crime? Three gender-critical posts on X. This is despite the fact that gender-critical beliefs are protected under the Equality Act 2010 and were reaffirmed by last year's landmark Supreme Court ruling, which settled that "sex" is defined by biology, not gender identity.
When Graham was released, he was placed under draconian bail conditions, which initially included a ban on posting on X.
Graham's case shocked us all and even caught the attention of the Trump administration, who have consistently called out the plight of freedom of speech in the UK. This sorry episode perfectly exemplified the free speech crisis in Britain today.
With the support of the Free Speech Union, Graham took legal action against the Met Police for wrongful arrest and breaches of his right to free speech.
General Secretary of the Free Speech Union, Lord Young, said: "I'm beginning to lose count of the number of cases we've fought in which the police have arrested someone for a tweet, decided to take no further action and then had to pay them substantial compensation for wrongful arrest.
"At some point you'd think the penny would drop: police our streets, not our tweets."
The Free Speech Union very much welcomes the Metropolitan Police's decision to apologise to Mr Linehan and pay him compensation; however, Graham should never have been arrested in the first place.

Der Comedian Graham Linehan ("Father Ted") wurde am Flughafen Heathrow von bewaffneten Polizisten verhaftet und mehrere Stunden verhört. Sein Verbrechen? Er hatte "böse, transkritische" Sachen auf X geschrieben.
Der Fall löste einen Aufschrei aus, weil es eines von Hunderten, Tausenden von "Meinungsdelikten" ist, für die brit. Bürger von der Polizei drangsaliert, verhört und teils festgenommen werden. Jeden Tag gibt es etwa dreißig Verhaftungen! Wegen Kommentaren in Sozialen Medien (hurty words...).
Jetzt hat die brit. Polizei sich bei Linehan entschuldigt und wird ihm 25.000 Pfund Entschädigung zahlen. Aber es ist leider nur ein Fall eines Prominenten. Die Masse der Bürger, die drangsaliert wird, bekommt nie eine Entschuldigung.

Total domination runs on two engines
Terror - isolates people, preventing them from organising together
Ideology - a ubiquitous explanation that is unfalsifiable.
The ideal subject for the regime is not a fanatic, but a person who can no longer discern between fact and fiction, and true and false. They only trust what they are told, not what they see. It’s not that they believe the lie, it’s that are too exhausted to form another belief.
This was said before the exhausting technology of social media was around, before the insistence that we a must have the right opinion on everything, on things like climate science and immunology, that most of us couldn’t possibly have expertise in. To avoid isolation we have to carry the right opinion or stay silent, so we select the opinion of the authorised experts, because we are too exhausted to use our own resources and too frightened to be isolated from society and the market. Even when our experts say ridiculous things, like human sex categories are made up of declarations and fabrics, people fall in because of the energy and the cost to resist.
The Free Speech Union has mixed feelings about Sir Keir Starmer’s departure as Prime Minister.
On the one hand, he was no friend of free speech. On the other, he has been an outstanding recruiting sergeant for the FSU.
Since he came to power in July 2024, the Free Speech Union’s membership has grown from 14,000 to 45,000.
Unfortunately, we have little faith that Andy Burnham will be any better when it comes to free speech.
Burnham has already called for greater restrictions on social media, and the Representation of the People Bill is likely to contain all kinds of threats to free speech. There is also no indication that he will abandon plans to ban “conversion therapy”, legislation that could see parents investigated or even prosecuted for conversations with their gender-confused children.
It won’t be long before Sir Keir hands the authoritarian lanyard to Andy. The Free Speech Union will be watching closely.

Maskenatteste: 73-jähriger Arzt lehnt Strafmilderung ab und stellt sich dem Verfahren
Vor dem Landgericht Freiburg hat der Allgemeinmediziner Dr. med. Thomas Külken am 15. Juni 2026 ein Angebot zur Strafmilderung ausgeschlagen – und stattdessen seine vollständige Stellungnahme verlesen. Verurteilt worden war er, weil er Patienten Maskenbefreiungen ausgestellt hatte.
Es ist ein Verfahren, das exemplarisch für viele steht: Dr. Thomas Külken, 73 Jahre alt, seit 46 Jahren Arzt und seit 39 Jahren Facharzt für Allgemeinmedizin, hatte während der Corona-Zeit 13 Patienten Atteste zur Befreiung von der Maskenpflicht ausgestellt. Das Amtsgericht Staufen verurteilte ihn dafür am 27. Juni 2022 zu einer Geldstrafe von 18.000 Euro, ersatzweise 180 Tagen Haft.
Ein Vorwurf, der sich wandelte:
Ursprünglich hatte die Staatsanwaltschaft behauptet, Külken habe die Atteste ohne vorherigen Patientenkontakt ausgestellt. Nachdem sich dieser Vorwurf als unzutreffend erwiesen hatte, lautete er fortan, die betroffenen Patienten hätten keine „hinreichend schweren" Erkrankungen gehabt.
Genau an diesem Punkt setzt Külkens Verteidigung an. Die einschlägige Corona-Verordnung Baden-Württemberg (§ 3 Abs. 2 Nr. 2) spreche lediglich von „gesundheitlichen Gründen" – nicht von Krankheiten und schon gar nicht von einem bestimmten Schweregrad. Daraus folgert er:
„Folglich war jeder Arzt bei jedem Patienten in der Pflicht, dessen Beschwerden zur Kenntnis zu nehmen."
Külken dokumentierte nach eigenen Angaben maskeninduzierte Beschwerden seiner Patienten – darunter Atemwegsbelastungen, Kopfschmerzen und Nasenbluten bei Kindern – und wertete diese als medizinisch legitime Gründe für eine Befreiung. Er beruft sich dabei auf die ärztliche Berufsordnung: „Ärztinnen und Ärzte üben ihren Beruf nach ihrem Gewissen aus."
Vorausgegangen: drei Praxisdurchsuchungen.
Dem Urteil vorausgegangen waren nach seiner Schilderung drei Durchsuchungen seiner Praxis. Den Weg in die Maßnahmenkritik beschreibt Külken als allmählichen Prozess in den Jahren 2020 und 2021, parallel zu einem aus seiner Sicht „massiven Anstieg" von Patienten mit Maskenproblemen.
Berufung in Freiburg – und ein ausgeschlagenes Angebot.
Am 15. Juni 2026 begann vor dem Landgericht Freiburg die Berufungsverhandlung; angesetzt sind vier Verhandlungstage. Bemerkenswert: Die Staatsanwaltschaft zog ihre eigene Berufung zurück. Die Vorsitzende Richterin bot an, die Berufung auf eine bloße Strafmilderung zu beschränken.
Külken lehnte ab. Statt einer Verfahrensverkürzung verlas er vor Gericht seine vollständige Stellungnahme – ein Schritt, mit dem er das Verfahren bewusst nicht als reine Frage der Strafhöhe, sondern als grundsätzliche Auseinandersetzung führen will.
Seine Kritik:
In seiner Stellungnahme geht Külken über den eigenen Fall hinaus. Er kritisiert eine seiner Ansicht nach propagandistische Verengung des öffentlichen Diskurses, die gesellschaftliche Spaltung in vermeintlich „gute" (regelkonforme) und „böse" (kritische) Bürger sowie die institutionelle Nähe von Robert-Koch-Institut und Staatsanwaltschaften zu den jeweils zuständigen Ministerien. Diese Einschätzungen gibt er ausdrücklich als seine persönliche Sicht wieder.
