KOKO TO CHIZ: SENATE MUST ACT 'FORTHWITH' ON SARA IMPEACHMENT
Senate Minority Leader Koko Pimentel has urged Senate President Chiz Escudero to convene the Senate Impeachment Court without delay, citing the constitutional mandate requiring the immediate trial of Vice President Sara Duterte.
In a letter dated February 14, Pimentel emphasized that Article XI, Section 3, Paragraph 4 of the 1987 Constitution clearly states that when at least one-third of House members endorse an impeachment complaint, the Senate must "forthwith" proceed with the trial.
Pimentel argued that the term "forthwith" should be interpreted according to its plain and ordinary meaning under the Verba Legis Rule, noting that the Merriam-Webster Dictionary defines it as "without any delay" or "without interval of time."
He also referenced the official Filipino translation of the Constitution, which uses the word "agad" for "forthwith", further reinforcing the sense of urgency in the Senate's obligation.
"The synonyms of this Filipino word include 'madali,' 'bigla,' 'dagli,' or 'karakaraka' which denote urgency or promptness," Pimentel wrote.
He reminded Escudero that the Senate has a constitutional duty to act on Duterte's impeachment immediately, stressing that any delay violates the Constitution.
"The above elaboration affirms that it is the Senate's duty to act on the impeachment case of Vice President Sara Duterte 'without any delay' or 'without interval of time.' I repeat that this is the Senate's DUTY," Pimentel wrote.
Given the gravity of impeachment proceedings, Pimentel urged Escudero to ensure that the Senate upholds its duty with urgency and diligence.
