UU MELARANG ORGANISASI MAHASISWA MELAKSANAKAN DEBAT BAKAL CAPRES DAN KEGIATAN POLITIK PRAKTIS LAINNYA

Ada yang bilang, Karena BEM UI mengundang dan menantang Bacapres bukan Capres untuk debat, jadi boleh, karena tidak melanggar UU Pemilu dan tidak menggunakan UU Pemilu. Apakah benar boleh?

Dalam UU Pendidikan Tinggi diatur tentang Kebebasan Akademik, Kebebasan Mimbar Akademik, dan Otonomi Keilmuan. Kebebasan ini harus terbebas dari Politik Praktis. Jadi dilarang untuk melakukan kegiatan politik Praktis. Artinya debat Bacapres di universitas atau mengatasnamakan universitas dilarang.

Dan dalam UU Pendidikan Tinggi, mimbar akademik itu wewenang dari Profesor atau dosen bukan Mahasiswa atau organisasi Mahasiswa, makanya pernah digugat ke MK karena merasa ada pembatasan kewenangan untuk diskusi, seminar dan kegiatan sejenisnya oleh mahasiswa, tapi gugatan itu ditolak oleh MK.

Artinya apa? Artinya ketika menggunakan UU Pemilu, yang bisa menyelenggarakan di kampus adalah Pelaksana Kampanye, bukan Kampus, Mahasiswa atau Organisasi Mahasiswa. Ketika menggunakan UU Pendidikan Tinggi, yang menyelenggarakan adalah Dosen atau profesor, bukan Mahasiswa atau organisasi Mahasiswa.

Apakah boleh organisasi mahasiswa melaksanakan politik praktis demgan mengundang Bacapres debat? Tentu secara aturan tidak boleh, baik UU Pendidikan Tinggi maupun UU Pemilu. Mereka adalah pihak yang seharusnya menerima pendidikan politik bukan yang memberikan pendidikan politik.

Oleh karena itulah, secara Hukum atau aturan, pendidikan politik untuk urusan pemilu ada di Partai Politik dan Penyelenggara Pemilu. Secara pengalaman, Pemilu itu pelakunya adalah Partai Politik dan Penyelenggara Pemilu. Jadi dilihat dari sisi hukum atau aturan dan kemampuan, tentu tidak layak jika yang seharusnya diberikan pendidikan politik malah memberikan pendidikan politik.
