Today I introduced the Public Health Amendment (Immunisation) Bill 2026. This is the first major legislative push in NSW in over eight years to restore parental rights and vaccine choice.
In 2017 the NSW Government quietly removed the conscientious objector exemption that had existed for decades and expanded the “no jab, no play” rules to every school and childcare centre in the state. Parents who had carefully weighed the benefits and risks with their doctor suddenly had the door slammed in their face. The State decided it knew better.
More and more parents are selective about vaccines after the dangerous and ineffective COVID vaccine was forced on the entire population. These parents are not extremists for wanting to make informed health decisions for their own children.
Libertarians don't believe you should have to co-parent with the government, so this Bill reverses those 2017 changes and puts power back with parents where it belongs. Specifically, it does three things:
1. Limits the immunisation enrolment requirements to pre-2017 rules.
2. Fully restores the conscientious objector pathway from the schools it applies to, so parents who have weighed up the risks can still make the decision themselves.
3. Keeps the medical objection pathway intact.
Nothing in this Bill stops any parent from fully vaccinating their child. It simply stops the State from punishing parents who, after proper medical advice, choose a different path for their son or daughter. So it's not an anti-vax Bill, it's a Bill supporting parental rights and basic freedoms.
Coercion is not health policy, it's authoritarian overreach.

The government’s grip on the family unit starts long before the first school bell rings. Right now, billions in taxpayer-funded childcare subsidies are funnelled directly into corporate daycare centres, bypassing the very people who matter most: the parents.
The Libertarian Party NSW believes it’s time to cut out the middleman. We have a very simple message for the bureaucrats: We do not want to co-parent with the government. You shouldn't have to seek state approval for how your child is raised or where your tax dollars go.
Instead of subsidising institutions that act as the first stage of state-managed upbringing, we demand that childcare funding be redirected directly into the hands of parents. Whether you choose to stay home, hire a nanny, or use a local co-op, the choice, and the cash, should be yours. By funding the provider instead of the parent, the government dictates your lifestyle. In 2026, Australia’s global standing as a bastion of freedom is under serious pressure, with our nation currently ranked 29th in the world for press freedom. This decline is the direct result of a legal system that lacks an explicit, constitutional right to free speech. Instead, we rely on "implied rights" that are easily brushed aside by governments more interested in policing "offense" than protecting the individual's right to speak.
We have already seen the devastating impact of these laws on individuals like Bill Leak and Andrew Bolt. In 2016, Bill Leak was subjected to a grueling investigation for a satirical cartoon, proving that the legal process itself is used as a weapon to punish "wrongthink." Similarly, Andrew Bolt was silenced under Section 18C because his tone in questioning taxpayer-funded grants was deemed "offensive." When the state polices the style of a debate, it effectively controls the debate itself.
In New South Wales, the situation has escalated with "Public Assembly Restriction Declarations," giving police unprecedented power to ban protests and conduct warrantless searches. When the state begins banning specific slogans and making peaceful assembly a conditional privilege, we are moving toward an authoritarian police state. The NSW Libertarians believe we must repeal Section 18C and enshrine an ironclad guarantee of Free Speech in our Constitution. Only by protecting the right to be provocative can we ensure the truth is always told.

In 2016, cartoonist Bill Leak became the face of a free speech crisis when the Australian Human Rights Commission investigated him under Section 18C of the Racial Discrimination Act. Despite Section 18D supposedly protecting artistic expression, the law was weaponised against Leak for a satirical drawing that addressed complex social issues. This investigation proved that under current Australian law, a citizen can be hauled before a commission not for inciting violence, but for the subjective "crime" of causing offense or insult.
The NSW Libertarians believe Bill Leak was unfairly persecuted by a system that prioritizes hurt feelings over fundamental liberties. The "process as punishment" took a massive toll on Leak’s health and livelihood before his untimely death in 2017. This case highlights the chilling effect 18C has on public discourse, where the fear of legal costs and character assassination silences dissent.
We must repeal Section 18C to ensure no Australian is punished for their opinions. Furthermore, as the only Western democracy without a clear constitutional guarantee of free speech, Australia must enshrine these rights in our founding document. We stand for the right to speak, write, and draw without government interference.

When Victoria’s “hate speech” laws were brought in last year, the Coalition and One Nation opposed them, as did the Libertarians. But today, the Government passed a bill to make these laws far easier to use. The Coalition and One Nation caved in and sided with the Government.
But the real story is what the Greens did.
