No: EE. UU. no “admitió” que el Cartel de los Soles no existiera

El titular de El Espectador es falso por inducción. No informa: confunde.

Estados Unidos no ha dicho que el Cartel de los Soles “no era real”.
Lo que hizo el Departamento de Justicia fue afinar técnicamente la acusación penal contra Nicolás Maduro para no depender de probar la existencia formal de una organización con ese nombre.

1) La trampa del titular

Decir que EE. UU. “admite que no existía un cártel” sugiere que:

-todo fue exagerado,

-no había narcotráfico organizado,

-Maduro solo era “corrupto”.

Eso es jurídicamente incorrecto.

2) Qué dice realmente el indictment

El indictment afirma que Maduro:

-participó, protegió y perpetuó un sistema criminal,

-desde el Estado venezolano,

-en el que civiles, militares e inteligencia

-se enriquecían con el narcotráfico,

-bajo un sistema de patrocinio criminal conocido como Cartel de los Soles.

La fiscalía no necesita probar que el “Cartel” sea una banda con estatutos para demostrar:

-conspiración,

-narcotráfico agravado,

-uso del aparato estatal para el crimen,

-responsabilidad penal individual.

En derecho penal federal, eso es más sólido, no más débil.

3) Corrupción vs. narcotráfico: una falsa disyuntiva

El titular intenta separar:

“corrupción”
de
“cártel de droga”.

Pero el propio expediente muestra que la corrupción era el mecanismo para proteger el narcotráfico. No son categorías excluyentes. Son partes del mismo esquema criminal.

4) Por qué el DOJ ajusta el lenguaje

Porque en juicio:

-los nombres simbólicos sobran,

-los hechos probados mandan.

-El delito no desaparece porque se depure una etiqueta.

La responsabilidad no se diluye porque se evite un debate semántico.

Conclusión

EE. UU. no absolvió a nadie.
No negó el narcotráfico.
No “rebajó” el caso.
Hizo lo contrario: lo blindó jurídicamente.

Presentar esto como una rectificación histórica es desinformar.
Y cuando se confunde deliberadamente al público en un proceso penal de esta magnitud, no es un error periodístico: es una distorsión grave de la realidad jurídica.

Los hechos siguen intactos.
El proceso avanza.
Los titulares engañosos no cambian los expedientes.
