这个律师的解读是错误的。美国移���法一直有规定，有违法记录的绿卡持有者在入境时将被认为是重新入境。最高法院的解释是：1/此条款适用于被检方起诉的人，（申诉人辩解称此条款只适用于被判有罪的人），2/允许暂时入境后若被法院判有罪才会被递解出境。也就是说被起诉的绿卡持有者不要出国。

此案涉及的绿卡持有者Lau在2007年获得绿卡。2012年5月7号，他被新泽西州起诉。在等待自己的官司开庭时，他飞回了中国，同年在返回美国时被发现有被起诉记录。边境方面因此认为他是重新申请入境，并暂时允许他进入美国。他于2013年6月自己主动认罪后才开始启动递解程序。
