A driver is dead after his car left the roadway and struck a disabled tractor-trailer stopped in a construction zone on I-75 in Troy, Ohio.
The truck likely had a mechanical breakdown. But “mechanical failure” isn’t a defense — it’s the start of the inquiry.
Trucking companies have a federal duty to maintain their fleet. 49 CFR 396.3 requires systematic inspection, repair, and maintenance programs. A breakdown on the highway raises the question: was this failure foreseeable? Was the vehicle properly inspected before it left the yard?
And once stopped, the duty doesn’t end. Federal law requires specific warning devices — triangles, flares, hazard lights — placed at defined distances from a disabled CMV (49 CFR 392.22). In a construction zone, where lane space is already compressed, those precautions matter even more.
Roads are engineered with fog lines, rumble strips, and shoulders precisely because driver drift is foreseeable. Engineers plan for human error. The question in cases like this is whether the trucking company did too — or whether a broken-down truck became an unmarked hazard in a space drivers are conditioned to trust as clear.
A “stopped” truck is not automatically a “safe” truck. Liability isn’t always where it looks.
