Under the Fugitive Slave Act of 1850, the official who decided whether a Black person was free or enslaved was paid by the outcome.

Ten dollars if he ruled the person was a slave. Five dollars if he ruled they were free.

That is written into the law. The stated justification was extra paperwork for a certificate of removal.

Understand what that does to a hearing: the man on the bench doubled his fee by ruling one way.

The accused person was not permitted to testify. There was no jury. A sworn affidavit from a claimant hundreds of miles away was sufficient evidence.

And the Act required ordinary citizens in free states to assist in captures — with a fine of a thousand dollars and imprisonment for refusing.

It made every American a potential slave catcher and paid the judges a bonus for saying yes.

Free Black people in Northern cities began carrying papers, sleeping in shifts, and in some towns leaving for Canada in the hundreds within weeks of it passing.

The price of a human being's freedom, in that courtroom, was a five-dollar difference in a clerk's fee.
