My article published today for Opinio Juris on the President's recent 'Proclamation on Securing the Border', the 'Asylum Transit Ban' regulation, and their compounding, ruinous effects on the right to seek asylum at our Southern Border. https://t.co/EHkeVG7Wkq
I testified yesterday at a hearing, again about immigrants and crime. Nothing makes the Republicans more infuriated than pointing out that immigrants lower the crime rate.
Rep. Frank's amendment making the third country removal provision discretionary, rather than mandatory, passed through the committee and remains exists as part of the statute today.
Reading through this rule now. It seems poised to create a pipeline between USCIS and the 'deportation courts' by harvesting cases ripe for pretermission and third-country removals. It even acknowledges that USCIS will refer applications it could have granted.
"For far too long, the asylum system has been exploited for purposes of delay and work authorization, not legitimate claims of protection. America's asylum system exists to protect individuals who genuinely fear persecution and this rule will help ensure that resources are directed to the timely adjudication of those claims instead of to those seeking to use the system as a loophole." - @USCISJoe

It is reasonable to assume that legitimate asylum claims will be caught up in this and churned out by the imm court deportation mills. It will also create a lot of 'in absentia' problems for any who don't receive notice. And it applies to filed cases, not just prospective ones!
With this and the ending of TPS for Haitians and Syrians, it truly feels like the immigration laws are now just suggestions on paper that an administration can choose not to follow. The US has fully entered a post-asylum reality.
BREAKING: Supreme Court clears way for Trump administration to revive immigration policy that limited how many people could apply for asylum. https://t.co/TL93VNEeVg
Trump's new executive order will ban, over the next three years, more than 140,000 spouses, fiancés, and minor children of US citizens and legal permanent residents. Nearly 100,000 nuclear family of US citizens. Unconscionable

Not content with cutting off access to asylum at the border, the current administration is now nullifying lodged asylum claims through 'pretermission' in imm courts—essentially moving to block the asylum claim on the basis that a third country will take the asylum-seeker in.
NEW: A major shift underway in recent months kicked into high gear this week, with ICE attorneys around the country asking immigration judges to toss out most asylum applications on the grounds of "safe third country" agreements signed with Uganda, Honduras, Ecuador, and others.
ACHPR's formally adopts resolution 645 in response to US & EU externalization efforts that exhibit a 'lack of guarantees for the protection of fundamental human rights' for states that 'have agreed to receive, detain, or expel migrants' on their behalf.'

My mandate led or joined 26 communications to @usmissiongeneva since the #USA's last UPR review in 2020. Not only has the US govt failed to respond to any comms this year, it also recently announced its withdrawal from the UPR process altogether. (1/9)

Disappointing. This UPR—occurring at the outset of the current administration's term—could have had a sizeable impact stateside, particularly with ongoing litigation. But also an unsurprising decision for that same reason.

This is the Chief of the U.S. Border Patrol saying that asylum is dead — acknowledging that the Trump administration has chosen to simply ignore the laws written by Congress that guarantee the right to seek asylum.
BREAKING: Supreme Court permits Trump administration to resume third country removals — like deportations to Sudan — with minimal notice.
6-3 with Soromayor, Kagan and Jackson dissenting. https://t.co/532wDuezRJ
BREAKING: A senior ICE official tells @FoxNews that ICE made 2,368 nationwide arrests on Wednesday, a new daily record high for the agency. It comes just one day after setting the previous record high on Tuesday, with 2,267 arrests, and it's a significant increase over the daily average of 1,600 arrests ICE arrests last week.
We've now seen back-to-back days of record high ICE arrests, which I'm told can be attributed to increased enforcement at worksites, immigration court, and scooping up "collaterals", (people in the US illegally who were found with an ICE target, but were not the target themselves).
ICE sources tell FOX if the "Big Beautiful Bill" passes as advertised with funding for 10,000 additional ICE personnel and tens of thousands of new ICE beds, ICE will be "supercharged" and arrests will 'shoot through the roof".
White House wants 3,000 arrests per day, and ICE is getting closer to it with its limited current resources.
Cato published my review of the ~240 Venezuelans the US government renditioned 2 months ago to Salvador’s notorious prison. We identified FIFTY who came legally, never violated any immigration law, but are imprisoned at the US government’s request and at US taxpayer expense.
