Catherine Herridge says the question is no longer what the intelligence records reveal about the 2020 election interference.

The question now is whether anyone will be held accountable.

Herridge detailed the “buffet of choices” the administration has available when it comes to criminal statutes to pursue charges against the intelligence officials involved.

HERRIDGE: “I think this is one of the most frustrating things for folks at home and, you know, all over social media is they’re like, what am I going to see a perp walk? When am I going to see criminal charges?”

“I did a little research and they’re actually multiple criminal statutes that were violated here.”

“There’s something which is essentially the abuse of your position as a member of the government, sort of color of law is the statute.”

“There could be violations under the military code of justice.”

“Many of these intelligence agencies fall under the Department of War.”

“There are conspiracy charges and then they’re more ethics violations under the senior executive service.”

An adult daycare owner and a pharmacy owner teamed up in Queens to defraud Medicare and Medicaid out of $120 million.

And here is the part that matters. This happened in the exact Flushing neighborhood Nick Shirley and Dr. Oz walked through a few days ago, the one with dozens of pharmacies stacked together and adult daycares billing for thousands of patients. This case is a real, charged example of the precise fraud those red flags point to.

Prosecutors say Inwoo "Tony" Kim, 42, owned a pharmacy and two social adult daycares, and Daniel Lee, 56, was a program director. Between 2016 and 2026 they allegedly paid the elderly residents cash and supermarket gift cards to do two things: enroll in the daycares for billable services, and fill prescriptions at Kim's pharmacy. The government paid for all of it.

The catch is that the services were either medically unnecessary or never actually provided.

Over a decade, that added up. Medicaid paid about $62 million for the daycare services. Medicare paid the pharmacy about $58 million for drugs. Roughly $120 million total, out of the same pot of money you fund with your premiums and taxes.

And they wrote it all down. The complaint quotes Kim texting a co-conspirator, "Please give the $10,000 to the Korean members first." Lee texted, "I gave the payment," and "I left the envelope with Tony." Auditors even found daycare sign-in sheets with pre-filled dates, the same handwriting for dozens of names, and attendance logged on a Sunday when the place was closed.

The wild thing is how long the flags were up. HHS had been investigating Kim since 2021. State auditors flagged the suspicious sign-in sheets during a 2024 site visit. A health plan had already received kickback complaints. The scheme still ran for years.

It ended when the FBI came through the door. Agents executed multiple search warrants, seized several bank accounts, and pulled the incriminating texts, working alongside HHS-OIG, IRS Criminal Investigation, and the state comptroller. Each man now faces up to 10 years in federal prison.

So the red flags around that area are finally drawing serious attention.

If you haven't given your own prescription prices some serious attention lately, here's the pitch. When you pay cash at a transparent pharmacy, there is no government pot to raid and nobody to bribe. Fraud has nothing to feed on. The price is just the price.

Nick Shirley and Dr. Oz found a Flushing neighborhood with a dozen pharmacies stacked on top of each other. That's a great visual, but a lot of pharmacies isn't proof of anything. So I went digging into the actual data.

To know if a scheme is running you need all three layers: what the pharmacy does, what the patient does, and what the prescriber does. Luckily a random pharmacist walked up and handed us two of them.

She said patients in that neighborhood are soliciting the pharmacies. They walk in and ask what they'll be paid to bring their prescription there. So pharmacies are paying and patients are selling. That's a kickback on both ends. Case closed on two layers.

Which leaves the third. Where are the prescriptions coming from?

Pharmacy dispensing data isn't public at that level. But prescriber data is. So I pulled the CMS Medicare Part D file, filtered to Flushing NY, and searched five drugs I know are highly desirable for this exact scheme.

They're desirable because they pay far more than they cost:
Diclofenac epolamine patch: costs ~$100, pays ~$800
Omeprazole/sodium bicarbonate: costs ~$171, pays ~$2,000
Clemastine fumarate: costs ~$685, pays ~$3,441
Diclofenac potassium: costs ~$172, pays ~$4,176
Meloxicam submicronized: costs ~$150, pays ~$860

That gap is the fuel. It's wide enough to pay the patient, pay the doctor, and still leave the pharmacy with a fat wallet. Five scripts like that can clear $10,000 in profit a month.

Here's what the data shows. In that one zip code, those five drugs alone account for 52,667 claims and $42,080,976 in Medicare payments. That's $799 per claim, on a pain patch for sprains and bruises.

Diclofenac epolamine by itself: 47,250 claims, $31.9 million, spread across 216 different prescribers.

But here's what stopped me. When you sort by prescriber, the same doctor sits at the top of four of those five lists. Across those four drugs, he wrote 2,171 claims worth $5,160,819 in Medicare payments.

One prescriber. Five million dollars. If I were looking for fraud, I'd probably start by talking to him.

So now we have red flags at all three layers. Pharmacies paying. Patients selling. And one prescriber writing an extraordinary volume of exactly the drugs that make this math work.

That's not a good look.

To be clear, this is public billing data, not an indictment. Anomalous numbers aren't a conviction. But this is precisely the pattern investigators look for, and anybody with a laptop can pull it.
