The simultaneous demand for Nhlanhla Mkhwanazi’s presence by both the Madlanga Commission and the Parliamentary Ad Hoc Committee on the same dates stems from a clash of political tensions, and strategic maneuvering, not mere logistical oversight. The commission seeks broad systemic insights. The committee demands immediate political accountability. The ANC-led executive (including Minister Mchunu) has a vested interest in delaying or diluting Mkhwanazi’s testimony.

Keeping him occupied with the commission (a longer, judicial process) starves the parliamentary committee of timely evidence, shielding implicated officials. This is a classic “process as punishment” tactic, overwhelm a whistleblower with procedures to exhaust public attention. The EFF and opposition parties insist that Parliament, as the direct representative of the people, must hear Mkhwanazi first or concurrently, to ensure transparency and prevent evidence manipulation.

The commission’s schedule is set by the Department of Justice, while the committee’s schedule is set by Parliament. The lack of coordination is likely by design:

· It creates plausible deniability for those accused.
· It allows Mkhwanazi to be accused of “avoiding” Parliament if he prioritizes the commission.

As Julius Malema noted “They want to use the commission to silence him in Parliament... We won’t allow it.”

If he testifies first to the commission, his evidence becomes sub judice, limiting its use in Parliament. If he prioritizes Parliament, the commission (and its broader mandate) is delayed, risking accusations of obstructing justice. It is Mkhwanazi’s legal team that should navigate these waters carefully to avoid contempt charges or political backlash not Malema.

This conflict isn’t about schedules, it’s about whether accountability will be led by a judicial process (controlled by the executive) or by Parliament (accountable to the public).

The executive prefers the commission: slower, less public, and easier to influence.
The opposition demands parliamentary scrutiny: transparent, immediate, and politically consequential. The public deserves full, unfiltered testimony, not a diluted version filtered through legal and political maneuvering in commission.

This Is a Battle for Transparency

The scheduling clash is a proxy war between:

· Forces protecting the status quo (using the commission to delay).
· Forces demanding accountability (using Parliament to expose).

Mkhwanazi must testify to both, but on a timeline that serves justice, and public not politicians.
