When the Supreme Court stays silent, circuit splits grow louder. In a new Bargaining Table blog post, Partner Patrick Muldowney, Counsel Christian White and Summer Clerk Teddy Fronczak examine the Supreme Court’s June 15 denial of certiorari in Macy’s Inc. v. NLRB, leaving intact the Ninth Circuit’s endorsement of the NLRB’s expanded “make-whole” framework under Thryv, Inc. The resulting circuit split leaves the scope of the NLRB’s remedial authority unsettled with meaningful consequences for both employers and employees.

In a new IP Intelligence blog post, Partner Jason Hoffman reviews a Federal Circuit decision holding that patentees must show a realistic, non-hindsight search path, not just that prior art existed in a database, to establish estoppel. When artwork is lost during the Holocaust era resurfaces decades later, what does a truly "fair and just" restitution process require? As evidence continues to emerge decades later and litigation unfolds, our Asset Recovery team is fighting for our client Patricia J. Leahy after filing a complaint on her behalf to assert she is the rightful heir and owner of a Gustav Klimt portrait that disappeared nearly a century ago and, after being recently discovered at an art auction, became one of the most closely watched art restitution stories.
As reported by The New York Times and other media outlets, the complaint alleges that our client, a Lieser family heir, was excluded from a purported restitution process despite representations that all relevant heirs were included.
The BakerHostetler team is led by partners Oren Warshavsky, Gonzalo Zeballos, Tatiana Markel and Michelle Usitalo.
