1. Unfortunately, CJ KOOME has now made judicial recruitment of judges an exclusive internal process to promote judges and magistrates. Lawyers in private practice and academics are totally excluded from the process. Out of the 41 candidates shortlisted, only 8 are not judges.
2. CJ KOOME does even look at the records of judges during this promotion exercise, i.e., she doesn't look at the performance, competence records, and corrupt activities of judges. They are very good judges who have been shortlisted, but I also see some who should have left the judiciary ages ago. Why are the CJ and JSC shortlisting judges who are known to be corrupt and incompetent? Merit is critical in this exercise. Candidates who were high academic achievers and who finished top of their classes must be given special and important consideration.
3. The JSC should ensure that the court of appeal doesn't become an exclusive club of three tribes. The Court must reflect the face of the country. For instance Justices Charo and justice Chacha Mwita who has been amazing judges when they served in the constitutional division must be considered on the further consideration that they hail from Kilifi and Kuria respectively and the people of the Coast and Kuria don't have a single judge in the Court of Appeal. We need more ethnic minorities in the Court of Appeal, especially from Coast, Northern Kenya, Kuria, Samburu, Turkana, Pokot, and Masaai. That is, a very important reason why this recruitment exercise needs to be cancelled as candidates from these regions have been disqualified during the shortlisting process. Also, why is former IEBC boss Chebukati not shortlisted? Just because former President Uhuru referred to "Traitors"? I think JSC should stop playing politics and some members should not be allowed to pollute the process.
4. Last, women have a good share in the court. Their share should be maintained and not diluted.
5. Last, lastly...and this, I address members of the JSC who aren't judges. The commission must agree as follows before the interview process starts. 40% of the dominated candidates must come from the judiciary. 40% from lawyers in private practice. 20% from the civil service and faculties of law, etc...@omwanza
