If you’ve followed my work these past few years, it should leap out to you how and why Deneen is wrong here and embarrassingly in error for a ‘lauded’ public intellectual. America, these sophists will destroy you if you don’t understand your own Founding (which so many of you still don’t!!!!).

Deneen critiques a Lockean/social-contract abstraction, then projects it backward onto the American Founding. This is propaganda. I’ve documented in detail and at length through many substack articles, long form threads and posts why this is error and what pushing it as propaganda serves now (the attempt to attain a post constitutional America).

The Declaration of Independence (and thereby its operationalizing in the Constitution) does NOT ground liberty in autonomous will or social contract, but rather, in the created nature of the human person from which inalienable rights (antecedent to the state) are grounded.

Locke begins with autonomous individuals in a hypothetical state of nature who establish government by consent. Ontologically that is Hobbes. The very opposite of what the Founders established and what they were rejecting!!! If you don’t understand the role of Founder James Wilson in this (re: jurisprudence and Popular Sovereignty especially) you have much learning to do.

The Declaration begins with antecedent reality; created human nature, self-evident truths, the Laws of Nature and of Nature’s God and inalienable rights that government neither creates nor negotiates. That is not contract theory. It is not alienable. Political society does not manufacture rights through contract (contract theory is exactly what Technocracy is predicated upon); natural law constitutionalism (which the Founders established) exists to secure rights grounded in what man already is (not what he says, has or does - not what he ‘contracts’). Mistake (and/or deliberately misread and project backwards) that constitutive grammar - and the entire Founding is misread - and THIS ‘misreading’ has been pushed through sophistry serving propaganda and Deneen is only one of many ‘revered’ media mouthpieces for it.
