शाहरुख पठान की अंतरिम जमानत अर्जी वापस, जमानत से कड़कड़डूमा कोर्ट ने किया इनकार।

2020 के उत्तर-पूर्वी दिल्ली दंगों से जुड़े मामले में न्यायिक हिरासत में बंद शाहरुख पठान ने अपनी चचेरी बहन की शादी में शामिल होने के लिए कड़कड़डूमा कोर्ट में तीन दिन की अंतरिम जमानत की अर्जी दाखिल की थी।

5 सितंबर को सुनवाई के दौरान शाहरुख पठान की ओर से उनके वकील ने अर्जी वापस लेने की जानकारी अदालत को दी। इसके बाद अतिरिक्त सत्र न्यायाधीश समीर बाजप��यी ने मामले का निपटारा कर दिया। यानी इस मामले में अदालत ने तीन दिन की अंतरिम जमानत मंजूर नहीं की।

शाहरुख पठान फरवरी 2020 में जाफराबाद थाना क्षेत्र में दर्ज दंगा, हत्या के प्रयास समेत कई आरोपों से जुड़े मामले में न्यायिक हिरासत में हैं। 2020 के उत्तर-पूर्वी दिल्ली दंगों के दौरान एक पुलिसकर्मी की ओर पिस्तौल ताने उनकी तस्वीर सामने आने के बाद यह मामला व्यापक रूप से चर्चा में आया था।

वहीं, जनवरी 2020 म���ं जामिया के पास CAA विरोधी प्रदर्शन के दौरान गोली चलाने वाले रामभक्त गोपाल शर्मा ने एक छात्र को घायल किया था और उसे पुलिस ने मौके से हिरासत में लिया था। हालांकि, उसके मामले में कुछ रिपोर्ट के अनुसार “21 दिनों के अंदर ही जमानत” मिल गई थी।

सवाल यही है - अलग-अलग मामलों में अंतरिम जमानत और न्यायिक राहत के लिए अदालतें किन कानूनी परिस्थितियों और आधारों को देखती हैं?
