@alx So the Constitution (not Biden) requires the census to count everyone in each State (except Indians exempt from taxation), and "everyone" includes residents, citizens or not, whatever their immigrant status.
@alx Article I, Section 2 of the Constitution mandates the census. It was amended by Section 2 of the 14th Amendment to state that the "respective Numbers" of the "several States" will be determined by "counting the whole number of persons in each State, excluding Indians not taxed."

@allinwithchris@chrislhayes Chris Hayes is right -- BUT Trump is raising the immunity defense in the documents case in the 11th Circuit. If SCOTUS denied cert and allowed DC Circuit decision to stand, 11th might rule differently, and then there would be a split that SCOTUS would have to resolve.
