If someone who has already raised protection or human rights grounds wishes to raise new evidence or grounds, they will only be provided with a right of appeal if they can meet the ‘Fresh Claims’ test, if they do not their claim will be refused with no right of appeal.

This statement is factually incorrect. There is no situation where those with rejected claims can appeal multiple times.

Even in a protection appeal, there is no automatic right to further appeal. An appeal against a decision by the First-tier Tribunal requires permission, permission will only be granted due to an error of law.

The new Nationality & Borders Bill includes sweeping penalties for refugees who arrive spontaneously in the UK.

In actually positive immigration news, the #Graduate visa route opens today. Unlike its predecessor (Tier 1 (Post-Study Work) it doesn’t lead to settlement itself but does give new graduates the chance to get jobs, start business and families and extend their leave that way.

If you are an #EU National who has missed the Settlement Scheme deadline, don’t panic, but do take action now. There is Home Office guidance that indicates many can still apply and be considered but it is best to act as soon as you can.

If you can’t access a private solicitor there are amazing charities such as @WeAreSettled, campaign groups like @the3million and online resources like @freemovementlaw who can offer guidance and information!

This is a cause for serious concern. Expect there to be cases of people applying well into the future based on their EU rights and the private and family lives they have developed during extensive residence in the UK. This isn’t over yet.

What is reasonable? That’s a question a lot of #EU nationals living in the UK will be asking after the EU Settlement Scheme sputters to a close tomorrow.
